母亲上个月先签是由于父亲要等体检结果， 体检最后也正常，所以今天才签。据签应
该是因为回答的问题比较敏感。

than the physical exam which you have already ruled out), a statement of no
longer a member should suffice, unless he really held some sensitive party
role.

illegally. My poor was totally tracked, then he was given a piece of
statement about not admissible. If any of you know how to appeal, please
help. Do we need an attorney?

helped or encouraged someone to enter the U.S. in violation of law. This can
include lying on that person's visa application or something. What did he
do exactly? And who was it they are saying he tried to help enter the U.S.
in violation of law?
A waiver is possible but only if the person whom he helped to enter the U.S.
in violation of law was his spouse, child, or parent. |

发帖数: 8496 | 15 He was smuggled or used fake document into US but caught by boarder patrol
or airport immigration/customs and never got in? If he was never admitted
or paroled in (caught at POE or by CBP) he had no choice but to leave US.
If he was in US already even illegally, he should NOT leave US and should
try to gain legal stay or withholding removal in US. This is a permanent bar
after he left US. I-601 is difficult for citizen's parent. |

The case did meet the this requirement. and I also think it is a
mispresentation, do we need to admit it and appeal it?

发帖数: 12623 | 17 Your are not looking for a waiver. A waiver is for if he is really
inadmissible and you are asking them to still let him in. He does not
qualify for the waiver given the inadmissibility they say he has anyway.
Your position should be that he is not inadmissible in the first place, that
their decision that he is inadmissible is a mistake. Unfortunately, a visa
officer's decision generally cannot be appealed or reviewed.
He should talk with a lawyer to see what options he has. He can file a
Motion to Reconsider and maybe try to clarify any misunderstood facts and
show that he actually didn't help someone enter the U.S. illegally. But I'm
not sure what are the chances of success in that.
