I got a RFE on EB1A I-485 to establish that you have maintained the
nonimmigrant status from Sept 1, 2016.
This evidence may include the following:-
a. A photocopy of approval notices (form-i-797) for all extensions and
change of status.
b. A photocopy of Form i-20s (In My case its not applicable)
c. A photocopy of Form I-94 (front and back)
I got my 485 receipt on July 18, 2016 before my J1 was expired on August 31
2016. I am unemployed since Sep 1st 2016 and currently awaiting for new job
offer. So from Sep 1st 2016, I am on AOS without job. How should I response
to the REF? Is the 485 receipt sufficient for this issue (I think this is
immigrant status instead of non-)? Many thanks. | c**2
发帖数: 8496 | 2 you don't need to main a non-immigrant status after I-485 is received.
If the new job offer is imminent, just wait till you have the offer and send
it saying you will be working using your c9 EAD to continue to engage in
whatever you stated in your EB1A I-140 career. |
