employer帮我递交了H1B visa application
前不久收到公司的来信说H1B visa (starting from 10.1)已经批下来了
可是今天又收到了USCIS关于OPT的mail notice：
“The SEVIS records show that your status has been terminated. Submit a
statement explaining the reason for the termination and if you intend to
pursue this application.”
同时在USCIS网站查询OPT status也变为“requesting for evidence”
本人猜测是因为公司帮我申请了H1B visa，导致我的学生身份自动终止？所以USCIS不
能verify我的legal status as a student to apply for OPT?
哪位大牛帮忙给些建议该如何回复USCIS? |

date is July 14, 2011
H1B visa start date is October 1, 2010
is there any chance that USCIS will reject my OPT application? if USCIS rejects my OPT, will I be out of status immediately in the US?

发帖数: 66 | 5 It was automatically terminated due to the approval of H-1B. As the DSO said, it was a bug of the CLAIM system. The DSO has contacted SEVIS to reclaim my status, from the date that I will start work to the date that H-1B will become effective. No result to report yet.
BTW, as long as H-1B is approved within the period of the new I-20, the student is legally in-status even though the student status is terminated in SEVIS.

it should not happen to everyone in similar situation |

I guess that's why H-1B is approved while OPT is pending

发帖数: 66 | 11 更新一下，昨天查状态OPT终于批了。简要经过总结如下：
5月初接受公司offer，几乎同时申请OPT与H-1B（加急）
6月下旬收到公司通知H-1B已批
7月8号收到USCIS的Request for evidence，告知我的SEVIS状态被terminate，要求回
信解释，同时OPT申请被suspend
7月中旬学校DSO告知由于H-1B approval，SEVIS状态被CLAIMS自动终止，属系统错误
7月15号左右DSO在SEVIS Help Desk提交申请，要求重新恢复我的SEVIS状态
7月22号SEVIS一直没有回信，SEVIS状态也没有恢复，遂回信USCIS，附上DSO
supporting letter，H-1B approval notice，and offer letter，并要求加急处理OPT
7月27号OPT approved，但是SEVIS状态仍未恢复，DSO告知会继续敦促SEVIS更新状态
提醒大家，如果同时申请OPT和加急H-1B，有可能会出现上述情况。但是系里另外一位
同学跟我情况类似(H-1B早于OPT approved），他的OPT申请却没有
