不是曾经申请过H1站过名额，再次申请就不需要了么？
我本来是想让他递交h1的时候再withdraw我的F1. 如果我立即取消，我立马就没身份了。
另外， 即使F1被批准，似乎也不应该影响H1的申请，身边很多人都是这样的么

我5月中被雷，6月初移民局收到I539,开学日期也是6月初。之后就一直Pending到现在
。律师的意思是即使8月份H1批准（有可能让我出境），5月到8月之间也是没身份的（
不算F1也不算H1)，他的观点就是补充资料（包括被雷，找工作，申请学校之类）的让
移民局不追究当中的gap。
他之所以让我取消F1是觉得因为一旦批准的话有如下结果
1.我要去上课让移民局觉得我确实是想读书
2.要重新占用名额和10/1开始
3.我的F1不肯能被批准，因为SEVIS requires you to report to school & actually
begin classes within proscribed time periods of 15 or 30 day
我现在很想证明他是错的，但找遍了也没有官方关于第二条的说明。我要是发别的律师
说的话，或者什么forum上的东西，没办法说服他，只有官方的解释才能够发给他。

. 1184) is amended by adding at the end the following new subsection:
“(m)(1) A nonimmigrant alien described in paragraph (2) who was previously
issued a visa or otherwise provided nonimmigrant status under section 101(a
)(15)(H)(i)(b) is authorized to accept new employment upon the filing by the
prospective employer of a new petition on behalf of such nonimmigrant as
provided under subsection (a). Employment authorization shall continue for
such alien until the new petition is adjudicated. If the new petition is
denied, such authorization shall cease.
“(2) A nonimmigrant alien described in this paragraph is a nonimmigrant
alien--
“(A) who has been lawfully admitted into the United States;
“(B) on whose behalf an employer has filed nonfrivolous petition for new
employment before the date of expiration of the period of stay authorized by
the Attorney General; and
“(C) who, subsequent to such lawful admission, has not been employed
without authorization in the United States before the filing of such
petition.”.
(b) EFFECTIVE DATE- The amendment made by subsection (a) shall apply to
petitions filed before, on, or after the date of enactment of this Act.
