去年H1b抽中以后我本来打算在10月1号前跳槽的 后来新东家律师发来如下一段话：
I want you to be aware that USCIS is now challenging H-1B petitions that are
filed earlier than October 1, 2014, where a new employer (which would be us
in this case) is requesting a change of status from F-1 to H-1B and the
worker is not currently in H-1B status yet and the worker’s first cap
approval was a Change of Status approval (from F-1 to H-1B) with an
effective start date of October 1, 2014. Your H-1B petition with your
previous employer was filed as a Change of Status and has an effective start
date of October 1, 2014, so this would be applicable in your case.
USCIS is now issuing Notice of Intent to Deny for such cases and arguing
that such workers have not yet been counted against the H-1B cap since your
current employer filed a Change of Status cap petition for you for an
effective start date of Oct. 1, 2014. This means that you would be counted
against the cap after October 1, 2014.
As a result, our recommendation is to proceed with filing but wait to file
after October 1, 2014.

发帖数: 2165 | 11 我听说是，原公司提交withdraw申请以后，
USCIS大概还有一两个月才会真正处理（revoke）
有些公司也未必马上就withdraw
只要在revoke前就transfer成功也还是可能的，至少以前有过例子 |
