跟老板闹翻了。现在需要向他提供所有研究材料数据。尽管所有的实验是我一手包办,
文章也写的只剩讨论部分,老板已经明说了不会给我第一作者。想请教一下,我可不可
以只提供原始数据。还是必须把分析结果,包括画好的图表(final form in
publication)统统给他?
还有,我为committee meeting准备了powerpoint presentation. 里面有以前实验结果
的最终图表,还有大量的我对以后实验进展方向的设想,具体做法。我可以认为这份文
件是我个人的知识产权吗?现在老板不问而取,我可以告吗?
最最重要的是,这份文件我全部在家完成。在开会那一天为了方便(我无laptop),在
实验室公用电脑上存了备份,并作最终修改。此计算机没有设密码,实验室任何人都可
以用,实际上只有我和另一个数星期前已被老板赶走的学生在用。电脑里所有文件都是
我和那个学生的。此电脑只有一个用户帐号,即为那个学生的名字。昨天同老板,系主
任开会时,老板提出来要这份文件,我拒绝了,理由是:“This is my personal
intellectual property.”系主任同意,说我

有两个问题 1 那个ppt的知识产权是否归你所有, 2 你以administrator身份进入老板
已经改了密码的电脑,并删除电脑中文件是否算trespasss(?).
美国法我只知道皮毛,只能从common sense说说。找个律师是你应该做的。
1 大多数学校都会有严格的知识产权政策,essentially规定学校owns almost everything.
你这里的争议可能会大些,因为如你所说,里面有“大量的我对以后实验进展方向的
设想,具体做法,”而且“全部在家完成。”如果这些东西你从未disclose给学校,你
的机会可能大些。反之,你的机会可能小些。
仔细看你当时的合同还有学校的政策,和律师谈谈。
2 如果你还没被解雇,还有相应的权限,你的机会应该比较大。
Again, talk to a lawyer. 学校里应该有法律顾问,你先咨询一下。

It really does not matter where you create the idea or proposal as long as
you are acting in your academic/professional capacity. If they are directly
related to your research work at school, they will be the school's property.
If they are only tangentially related to your research, then you have a
better case.
Once your adviser had made it clear that he did not want you to have access
to that computer, your action was certainly illegal. Taking something whose

Not a big deal. You should be fine as long as you created the files
yourself. Just tell the truth that you are the author of the files and have
a dispute with your adviser as to who actually owns the files, and that you
are willing to put the files in escrow pending the resolution of the
dispute.
It appears to me that the real issue is not whether the school owns your IP
(very likely, as other posters stated), but whether your adviser owns your

I am not sure about your first advice. It's illegal to delete files on a lab
computer against the instruction of the administrator. It is irrelevant who
created those files as long as they are stored on a lab computer and deemed
school property.

DarthSidious has a valid concern, although the question becomes "who is the
administrator here?" It could be both the OP and the adviser . The adviser
does not appear to have legal rights (in order to make it "illegal") to
prevent the OP from deleting his work products. This is a matter of
personal dispute, wherein one administrator is accusing the other stealing
the files. On the other hand, it would be a different story if the school
has specifically prohibited anyone from deleting such fil

think the professor is usually the ultimate boss of a lab. I also don't
think this is a larceny case, but a malicious destruction of school property
. The former is a specific intent crime, the latter a general intent one.
Anyway, it's better to consult a real attorney before taking any further
action, although I prefer direct negotiation with the adviser. It's unlikely
he will press any charges or the local attorney will have time to deal with
such a petty case. I am sure the department would p
