him. Cap H1B is more difficult to get. You need a stroke of luck to win the
lottery. Concerning your case, there are two possibilities:
(1） You once broke immigration rules.
(2) OPT is non-immigrant visa. You apply 140 based on that. Unfortunately,
you meet a hardcore immigration officer. But the majority should not have
that trouble.
Tell us more about your REF. So we could figure out for you. |

1. Family files I539 changing status to B-2
2. You grab all the documents (especially contract/offer letter), go to
Canada/Mexico US consulate general apply for H-1B. Have your PD fax/call
them
---if granted, you start residency right away
---if denied, you go back to China right away (not able to come back US),
can apply there again
---if 'administrative check' you stay in Canada till H-1B approved (normally
4-6weeks)

The memo about the affiliation to train the medical residents is not enough
to convince the immigration officer. We are requested to provide more
evidence for that.

发帖数: 20 | 9 I know there are still a few community hospitals sponsoring H1 for FMG. The
residency starts July, NOT the fiscal date-OCT 1st, so their H1B must be
non-cap H1B unless they transferred current Cap H1B to the hospital.

是legal to the eyes of Uscis.
出境后被拘，进不来了 （没身份）。 |
