You have been granted a 240 day extension. You may go to any DL office to
apply for your Driver License renewal. Bring your immigration documents for

Dear Sir or Madam,
I am a citizen of China currently working in this country under an H-1B
working visa. My current I-94 form expires on xxxxx, 2010. With the
expiration of the I-94 my current NC driver's license also expires. I
visited the DMV office located on Arrowood Road in xxxxxx yesterday with my
Form I-797 indicating a timely filed application for an extension of stay. I
was told I could not renew my driver's license until I received my approved
I-94 form.
I am currently employed by xxxxxxx. My employer has applied for an extension
of my H-1B. My application has been received by USCIS and I have received
my USCIS receipt notice (Form I-797) indicating a timely filed application
for an extension of stay; however, I have not received the final approval
notice. According to the federal government's "Handbook for Employers",
Instructions for Completing Form I-9 (Employment Eligibility Verification
Form), page 9: with a foreign passport, an expired Form I-94 or I-94A
indicating employment authorized nonimmigrant status, and a USCIS receipt
notice (Form I-797) indicating a timely filed application for an extension
of stay, I am authorized to continue employment with the same employer until
the date of USCIS’ written decision, but not to exceed 240 days beginning
on the date of Form I-94 or I-94A expiration. Having met these requirements
I am allowed to continue working for my employer for an additional 240 days
past xxxxxx 2010, before which I should receive my approved I-94
documentation.
I need a valid driver's license to commute from my home in South Charlotte
to our uptown office. I'm hoping you will authorize an extension of my
current license based on receipt of my Form I-797 as I need to drive to my
job. Also, in December, I will be dropping my fourteen month-old daughter
off at day-care and picking her up at the end of the day during my commute.
I very much need access to an automobile.
