Ipod Touch does not have 3rd gen for 8GB, only for 16/32GB.
Obviously you did not do your homework about the item. You can not really
blame the seller as everyone
including apple sometimes call their 8GB model 3rd gen,
The only fault of seller is the warranty and that is for what you should file dispute against him.
