approved? May I do a J1 to J1 transfer for my new position? I heard H1B

你已经不能做J1transfer,因为会产生一个新的DS2019,而你现在的waiver是不cover它

LZ must get final approval notice from USCIS by then the waiver case is
finished.

I understand the J1 transfer is just between two institutions, by which I
mean no approval from anybody is required. So, if I do transfer, I'll get a
new DS2019, what I need to do is to apply for J1 waiver again for the new J1
. Am I right?
I prefer to transfer instead of get a H1B which may take long time. I just
want to make sure the J1 transfer in my situation won't cause any problem,
like void the No Objection Letter or something.

发帖数: 2481 | 6 理论上说是这样, 可是你听说过USCIS推翻过DOS的waiver recommendation吗, 后面的
正式批准只不过是个程序而已.
关键是到这一步, lz的J1已经不能再做transfer了

发帖数: 2481 | 7 J1 waiver是由US DOS管理, USCIS是美国国内的机构, 不涉及外交事务
J1 waiver 整个过程的关键就是DOS收到大使馆的NOS然后给USCIS发出waiver
recommendation, 到这一步, 你的豁免事实上已经批准, 剩下的就是程序上由USCIS给
你寄I797通知, 因为在美国国内外国人事务是由USCIS直接管理
所以你现在再做J1 transfer会导致新的2年服务并且无法再豁免.

I heard the NOL is good for one year, and it is the main thing based on
which the waiver are processed.
