Sup. Court Rejects Anti–Gay Marriage Vote
By Michelle Garcia
The U.S. Supreme Court Tuesday rejected an appeal from antigay advocates
seeking to overturn Washington, D.C.'s marriage equality law, enacted in
2009, the Associated Press reports.
The court rejected the challenge led by Beltsville, Md., minister Harry
Jackson, who sued the District's Board of Elections and Ethics when that
board rejected his push to allow voters to decide whether Washington should
sanction marriage equality. The board ruled that putting such a question on
the ballot would violate its own antidiscrimination policies.
The Supreme Court held a private conference Friday to discuss the case,
Jackson v. The D.C. Board of Elections and Ethics. | g********d 发帖数: 4174 | 2 Back to top Post a Comment Report Abuse Name: Ryan

@Joseph and Davlin, this case was not decided on standing grounds (Jackson
was probably smart enough to find a DC resident who would agree to a be a co
-plaintiff) and would not have set a national precedent. The only issue
before the Court was whether the DC Board of Elections correctly interpreted
the DC Human Rights Act to make a referendum on the Civil Marriage Act
illegal discrimination, and if so, whether that interpretation conflicted
with the DC Charter. There were no Constitutional issues at stake and the
only federal law involved was the DC Home Rule Act. The only important legal
issue dealt with District of Columbia Home Rule, not gay rights. | m******1 发帖数: 19713 | |
