这片文章是力挺OBAMA的。OBAMA对GAY MARRIAGE的态度evolving,我对他的态度也
evolving,所以我同意这片文章。肯定有很多人不同意,认为马屁拍的太肉麻了,也可
以理解。
文章的大意是:
BILL CLINTON被称为the first black president,而OBAMA有可能是the first gay president,OBAMA是个CLOSETED EQUAL RIGHTS
SUPPORTER,现在正在慢慢出柜。标志性的事件当然就是他宣布DOMA
UNCONSTITUTIONAL,gay rights是OBAMA的 hiden agenda.他掩藏的方式是 compromise and incrementalism.“He is coming through — more
cunningly than most of us grasped.”,如果给他8年时间的话,他一定能在CIVIL
RIGHTS史上留下英名。[有人用统计模型预测,如果OBAMA连任,2016年之前DOMA会被
废除,20年后连MISSISSIPPI都会承认同性婚姻,这还是比较可信的]
让OBAMA决定不为DOMA辩护的原因之一Edith Schlain Windsor v. The United States
of America 这个案子,Edith Windor和Thea Spyer在一起44年,Thea患有multiple
sclerosis,这是一种长期慢慢折磨人的自身免疫病,她们可以说是风雨同舟了44年,
2007年她们在加拿大结婚,2009年Thea去世,给Edith留下了一笔遗产,他们所在的NY
州承认州外婚姻,但因为DOMA,联邦不承认,Edith为此要交$363,053的税。所以已经
81岁高龄的E还要为自己的权利而战。OBAMA不为DOMA辩护,共和党占多数的众院就要辩
护。OBAMA不愿意为DOMA辩护,HOUSE SPEAKER John Boehner 其实也不愿意。共和党
的旗帜性主张就是减税,尤其是death tax,你说他们怎么能为向在一起44年婚姻也被NY
州承认的Edith征$36万税来辩护???所以OBAMA聪明地把Boehner逼到一个墙角,
谁赢谁输我们等着瞧吧。

House Leaders to Defend DOMA

Members of the House leadership decided Wednesday that they would defend the
Defense of Marriage Act in federal lawsuits, stepping in for the Department
of Justice, which announced a halt to defending such cases, under the
direction of the president.
In a 3-2 vote by the members of the Bipartisan Legal Advisory Group, House
speaker John Boehner, majority leader Eric Cantor, and majority whip Kevin
McCarthy voted to defend the law, with Democratic leaders Nancy Pelosi and
Steny Hoyer voting in the minority.
“Given the complexity and number of cases, this legal challenge would sap
hundreds of thousands of taxpayer dollars, if not more, during a time of
limited fiscal resources,” Pelosi said in a statement. “Pursuing this
legal challenge distracts from our core challenges: creating jobs,
strengthening the middle class, and responsibly reducing the deficit. And
that is why I voted against this action today.”
There are currently 10 pending lawsuits challenging DOMA. A source told
Pelosi and Hoyer that the House's intervention would take at least of 18
months, and it may be years before the U.S. Supreme Court can hear the cases
involved.
Despite Boehner's statement touting the vote as being bipartisan, a group of
Democratic lawmakers say the decision was far from impartial. Democratic
representatives Jerrold Nadler, Barney Frank, Tammy Baldwin, Jared Polis,
David Cicilline, and John Conyers said in a statement shortly after the vote
that the action was a display of "partisanship at its worst."

I am not as positive about Obama's move as many people in the LGBT community
, simply because this seems to be nothing more than a political gimmick that
he used to please his supporters, as he is seeking reelection in two years.
It's impossible to repeal DOMA, with the current republican majority in the
House. The president himself never promised to repeal DOMA and he opposed
gay marriage, although he did promise and actually achieve to repeal DADT.
DOMA defines the line of the so called traditional values carried by most
americans and for a country with major christian influence, it is not
possible to challenge DOMA in the forseeable future. For most, even some
avid supporters of gay rights, calling the domestic partnership between two
men or two women "marriage" means the doomsday for their beliefs.
That being said, there's nothing more in Obama's executive power that he can
do to further the equal rights movement. (His administration is still
executing DOMA although he commanded it not to be defended by the DOJ, and
anybody who has the resources can step in to defend it for the
administration) He understands that LGBT community will always support
democrats because the republicans will do much worse and violate their
rights even more. On the other hand, he does not want to infuriate the
conservative America, which is of equal importance for his successful
reelection. I'm not saying Obama's being bad to the gay community, he's just
not a hater, but he is far from a gay friendly president.
Democrats can only do so much. And don't forget, DOMA was instituted by Bill
Clinton, a democratic president, who also opposed gay marriage. Between a
democrat who knows he'll get the vote and just doesn't care anymore, and a
republican who claims gay guys are going to hell, we're busted and stuck in
a mexican stalemate. How can you win if you have to choose from a worse and
a worst?
I myself can't wait for this stupid law to be struck down. The only chance
we have is through the supreme court, which unfortunately is equally
conservative nowadays. Ted Olson and David Boies teamed up to challenge Prop
8, which if they win, will be a long sought unprecedented victory for
millions of californians, and will prevent other states from using
referendum or public ballot as a foundation for the violation of equal
rights for homosexuals. But they are not challenging DOMA and the
constitutionality of DOMA can only be determined if a case directly involves
DOMA and falls into the judicial reviews of the supreme court. I sincerely
hope some of the conservative judges will die or retire so president Obama
can appoint someone with a value system that is not prehistoric. Then the
gay community will truly have a chance of happiness after all.

其实政客们做的一切都是为了讨好支持者和拉选票,这个无可厚非。我们不用关心他们
的实际动机是什么,只要我们的目的达到了就行了。政客在利用我们,我们难道不是也
在利用他们?
我同意你,通过立法程序repeal doma看来5年之内都不太可能,但是通过法庭判决的途
径还是非常有希望的。虽然现在高法的大法官们有一半是保守派,但是DOMA在法理上的
荒唐性和违宪性是显而易见的,即便保守派们也很难为它辩护。再说了,不是还有一个
中间派的大法官吗?我觉得我们还是可以拿到他的票的。

I'll write something about Justice Kennedy and his stance on issues of gay
rights later when I have time. But I'm not completely optimistic about
challenging DOMA in supreme court either, despite the fact that I believe it
's our only hope.

I'll do it over the weekend. From past experience, I'd say there is a good
chance that Justice Kennedy will vote for striking down Prop 8. On the other
hand, he is not likely to repeal DOMA with the power of judicial review.
