收到账单一看，上面写着可以申请出庭，并且红体字写着 officer will not be
present.
由于以前的经验是警察不出庭，ticket会取消，现在明着写 officer will not be
present，不知有什么鬼把戏。
是不是OC 既要搞speeding 创收,还要省警察出庭的加班费啊？

记得有人出个高招:一般每隔一段时间, 为方便警察出庭, 法庭会尽量把罚单集中在某
一天处理.约好的那天你临时宣称出不了, 要求改期. 而警察一般往往不会为了一个
CASE而去法庭.这样一来你就可以免掉罚款了.
现在不知是警察变得聪明了还是州政府更穷琢磨出这道高招.

发帖数: 51 | 5 California also has one more option to fight the ticket. See the back of
your ticket. It is called "trail by declaration". I have helped my friends
to fight this way, so far we won all the 4 cases. You can do an online
search for this.
I will see if I can put a post explaining how to do this in more details.

不过拖延战术已经不行了。上次上traffic school， 老师就说因为有网站专门收费帮人
搞拖延战术躲警察，现在法官对于拖延的Case 一般都不会dismiss 了。
估计现在加州各级政府都同仇敌忾联合起来搞创收。

First, wait for the letter from the court with the dollar amount and date
for court contest. Then start the following process.
1. Submit a Written Not Guilty Plea. this is the CVC 40519(b) form. See
sample below.
To contest your citation without a single court appearance, you must first
send the court a Written Not Guilty Plea. This will save the time and hassle
of appearing in court to plead not guilty in person. In the Written Not
Guilty Plea, you should also request a Trial by Written Declaration to avoid
the inconvienence of a court trial.
You must include the full bail amount indicated on your "courtesy" notice
when submitting a Written Not Guilty Plea. If you mail your plea, it must be
postmarked at least five days prior to your appearance date via certified
or registered mail. This appearance date is indicated on the bottom of your
ticket. If you have less than five days left before your appearance date,
you can still deliver your Written Not Guilty Plea to the court in person.
The check will be returned if you win.

The facts of my case are as follows: While driving on xxxxx on xxxxx(date),
I was stopped by SDPD Officer xxxxx (I.D.#xxxx) and was charged with
violating CVC 22349(a). Though Officer xxxxx has alleged that I was driving
80mph in a 65mph zone, I believe that I was driving no faster than 70 mph.
The Basic Speed Law, CVC 22350, states: "No person shall drive a vehicle
upon a highway at a speed greater than is reasonable or prudent having due
regard for weather, visibility, the traffic on, and the surface and width of
the highway, and in no event at a speed which endangers the safety of
persons or property."
On my citation, the officer noted that the road was dry and clear with light
traffic. Where I was stopped, Interstate 405 is a well-maintained freeway,
quite safe to travel on at approximately 70 mph with favorable weather and
road conditions.
Section (b) of Speed Law Violations, CVC 22351(b), states: "The speed of any
vehicle upon a highway in excess of the prima facie speed limits...or
established as authorized in this code is prima facie unlawful unless the
defendant establishes by competent evidence that the speed in excess of said
limits did not constitute a violation of the basic speed law at the time,
place and under the conditions then existing."
The conditions existing at the time and place of my stop (favorable
conditions attested to by Officer xxxxx in my citation) were favorable and
made the speed I was traveling Safe and Reasonable under these conditions.
As such, I know that I was not in violation of the basic speed law at the
time and place of my citation and, pursuant to CVC 22351(b), contest that my
speed at the time of my traffic stop was therefore not prima facie unlawful
.
I trust in the Court's fairness and believe that my citation should be
dismissed in the interest of justice.
If the court does not find in my favor in this case, I request a Trial de
Novo.
I declare under penalty of perjury under the laws of the State of California
