标 题: 弱问file extension是啥意思

参考了精华区,本人是:
changed from F1 to H1 on Oct 1, 2010 and is married and has a kid born on Feb 2010. First half year is paid by RA (年底需要跟学校索取W2表吗?).
I can file as resident married jointly for the whole year, and enjoy
standard deduction and tax treaty.
However if my H1 days < 183, you need to file extension first.
尽管看了First-Year Choice in pub 519, 还是不甚解.
请达人指教这个“file extension first |

Dual status - US tax resident started from 10/1/2010, and before this date
you were a non-tax resident because F1 holder is an exempt person. The days
you stayed in the US under F1 visa does not count for the 183 days, unless
you had stayed in the US for more than 5 years, which you have an option to
be taxed as a US tax resident. In short, you may need to file both 1040 (as
a return) & 1040NR (as a statement) in 2010 if yo

I only stayed in US for 2 years as a master student.
It seems that I can be treated as a U.S. resident for the entire year.
According to pub 519,
1. I was a nonresident alien at the beginning of the year
2. a resident alien at the end of the year
3. I am married to a resident alien at the end of the year (my wife was F-2
here for 2 years and I think she counts as resident)
4. My spouse joins you in making the choice.
Is it right?

我是从VA过来的,是不是用学校的W-2表报VA的州税呢?两张表的和报联邦税呢?
问的比较傻,请见谅哈

meet
the 183 days at the 2010 year end. Your F1/F2 days did not count for this
183
days rule!!! You indeed only have 92 US days counted from 10/1/2010 to
12/31/2010.
What you have quoted below is if you have married to an US citizen, or a
Greencard holder, or an US tax resident. Your wife is not treated as a
resident because of F2 status. She is also an exempt person.

if less than 183 days but more than 30 days, you have
a "first-year choice". which means if NOW, days in 2002
plus 1/3 of days in 2001 is 183 or more, you can treat the
days of H1 in 2001 as resident. thus you can file either as
dual-status, or if you were married at end of 2001, file
as resident. again, filing as resident is good. but if you
were single, filing as dual-status may not much beneficial,
but you may still able to take some deductions like mortgage
insterest or take credit
