r****m 发帖数: 5 | 1 I have a super dumb question about patent in general. Who can file application
for patent? Only the inventor or the first person who file the application?
BTW, what right does the patent protect? The right to manufacture or the
right to sell in a specific market? or both? I need to take Patent101:p | x********o 发帖数: 132 | 2

for ibm research and you invented something, the patent is owned by ibm
though you are the inventor

| r****m 发帖数: 5 | 4 thanks for both of you. the reason I asked is that a friend of mine have
access to the manufacturer of a patented product in China (the product is
patented in China, not high tech product, but industrial product). He wishes
to explore the North America market and wonders if he should patent the design
in the US before he makes the move. Actually, several wholesalers asked him
if he holds patent in the US. If this case, can he file patent application
on behalf of the manufacturer (the designer),

he could be sued later when/if he becomes successful. nobody will sue for
patent infringement if you aren't making any money, they only come after
you put in the work and helped create the market.. then they sue you and
take over
