以前实习的一个老板告诉我他们急需一个full time的员工，10月份上班。问我现在是
否来得及转身份，帮她做事情。（学业，他们会支持我part time读完）
我们已经开学了，我还有一年毕业，对他们的position,我非常感兴趣。
但是我这样中途申请H1b是不是有很大风险啊，有什么利弊〉

you have not finished your study?
What and how many years of past related job experiences do you have to
substitute the absence of degree to support your H1 petition?
F-1 can not work.
CIS will surely chanllenge your H1 without above. |

I had a MS degree in the US which is exactly matched with that position. Is
this enough?
BTW, if the current company file my H1 before October 1st.
Generally, how long does it take to get the approval from USCIS?

fiscal year 2011 is used up, the company has to wait until 04/01/2011 to
apply for fiscal year 2012's H-1B, which begins at 10/1/2011. There is still
quite a few H-1B quota left for fiscal year 2011, but it will be used up in
a few months, so your company needs to be fast.

发帖数: 15689 | 14 not necessary; if you continue to register, you will be F-1 until USCIS
approves you H-1B petition; if you do not register after the H-1B petition
is submitted, you will be in a period called "authorized stay", i.e. you don
't have any legal nonimmigrant status but you can stay legally in US. The
advantage of the former is that if USCIS denies your H-1B petition, you can
still stay in US legally as F-1; but in the latter case you don't have legal
status anymore and have to leave US.
