签证要今年12月才过期。听说OPT期间依然是学生，那么我可不可以用未过期的F1签证
回去一两周？因为年底才参加毕业典礼，万一海关拦人，可不可以把这个当做理由？多

如果你离开美国，回来的时候必须有offer或工资单，证明你在这里有工作 |

“You are correct that if you are on F-1 OPT and your visa is multiple entry
and not expired, you can use it to return to the U.S. However, you must
have a job offer letter and/or proof of employment for OPT and the signature
on your I-20 page 3 must be less than 6 months old on the day you return to
the U.S. You must also be prepared to prove if asked that you have not
had more than 90 days of unemployment since your OPT was approved.
There is always risk when you travel. However if you return before your
visa expires and have the required documents, it would be very unusual for
there to be problems at the border. Usually the problems occur when
students on OPT try to renew visas....which you do not need to do.
Finally, you must be prepared to prove that you will return to China when
your OPT is finished. Do you have any other applications pending with
Immigration that would contradict that intention?” |
