for myself and in the meantime, I submitted I-824 for my husband who is in
China. My I-485 is still pending now. I am working under H1B visa. My
husband applied H4 visa about ten days ago and it is under background check.
He is offered scholarship from Chinese government which allows him to come
to US to work for 1 year.
What is the best solution for him. Should he apply for J1 visa? If he
applies J1 visa, is he still allowed to submit I-485 in US? | F*********u

首先，follow-to-join得是绿卡持有者给配偶或子女申请的
你这绿卡还没批呢，怎么能file I-824 Application for Action on an APPROVED
Application or Petition呢
其次，你拿中国政府funding用J-1在美国工作，那基本就不能办waiver
必须回国服务2年，否则不能交I-485
再次，你2月份就交了485了，你老公为什么10天前才去签H-1B?
你老公应该在你交I-485之前就把签证办好，用H-4入境最好和你一起交485和AP EAD申请
然后或者离境等AP批了再用H-4入境来拿AP，或者在美国等到AP批准然后回国
现在如果需要工作，也可以用EAD
你现在这个搞的完全没有任何计划
至于你现在的情况，J-1是不行的，除非他打算几年后再办移民
等H-4批准再入境美国然后申请AP/EAD是可以的，不过如果在等签证clear之前你万一绿
了，那他的H-4就不能批准了，这样的话你可以申请follow-to-join,然后办移民签证，
这个估计得小一年，或者试着申请别的非移民签证入境吧，入境后3个月内不要交身份
转换申请，之后可以交。
