We are writing to bring to your attention a blatant transgression concerning
racial profiling and discrimination within your department in UCSD. The
ensuing link, which directs to Dr. Clifford P. Kubiak‘s research laboratory
, contains highly racially-insensitive and -inappropriate information. The
so-called
3rd lab rule, described as “don’t believe anything the Chinaman says”,
has profoundly violated basic moral and scientific standards at various
levels, and the fact that it comes from a publically funded research group
affiliated with a nationally recognized higher education institution is
appalling and unacceptable.
It is well-known, to both American people and Chinese expatriates who are
studying and living in USA, that Chinaman is a historically derogatory and
discriminatory term specifically targeting at the Chinese descendants, on a
par with the usage of N- on African Americans or K- on Jews. These racist
concepts and mentalities have not only completely contradicted with the fact
that a multitude of various peoples have each made indispensable
contributions to the progression of the United States in its history, but
also grossly violated such fundamental moral guidelines as all humans are
created equal.
As a Chinese, I am extremely disappointed to notice that the UC system, with
its immense resources and advanced research capacity, have failed to
properly oversee and instruct its employees on this critical issue.
Therefore, we strongly urge the UC system and especially the Chemistry
Department to take immediate actions to address this serious incident, and
to implement necessary reforms to ensure no similar violations be tolerated
and allowed in future.

Dear Chancellor,
My name is XXXXXX and I graduated from UCSD Summa Cum Laude in 2005
and since have been a proud life-time member of the UCSD Alumni
Association. I am writing to you about a racially discriminatory
comments posted by Professor Clifford Kubiak in the Chemistry
department.
In Professor Kubiak’s webpage, he listed “Don’t believe anything the
Chinaman says” as one of six of his laboratory rules. The usage of
“Chinaman” is inappropriate and racially insensitive to say the least.
As an Asian American, I was appalled by such public and racially
charged comment from a UCSD faculty member. I hope you will fully
investigate this issue and do your best effort to prevent future
racial discrimination on UCSD campus.
I hope for a quick and satisfactory resolution to this issue so I can
justify my continued financial contribution to the UCSD alumni fund
this year.

A set lab rules containing the word "Chinaman" were found on the group
website of Professor Clifford Kubiak of University of California, San Diego.
It wasn't until May of 2011 when this issue was discovered and raised in
several online Chinese forums. Many felt greatly offended by the lab rules
and wrote letter of complaints to the university and San Diego local media.
Under the pressure, the university and professor Kubiak issued statements of
apologies and the offending web page was taken down. This incident received
media coverages from San Diego Union Tribune and World Journal.

Lab Rules:
0. NO DISNEY MUSIC.
1. Don't be that guy.
2. If you can't turn on the instrument, you shouldn't use it.
3. Don't believe anything the Chinaman says. (Demoted from rules 1 & 2)
4. No ammount of time is acceptable for food-floor interaction, accept it,
it's gone.
5. If you start a phosphine fire - don't panic. Well, maybe a little.

Mingyu Guo, a lecturer at the University of Liverpool in England, wrote in
an email to The San Diego Union-Tribune. “At least in the U.S., the word ‘
Chinaman’ is usually considered derogatory. Usage of this term is strongly
discouraged by Asian American organizations."[1]

On 05/21/2011, The existence of the web page was disclosed on an Internet
forum for Chinese speaking academics, then numerous discussions followed on
many similar internet forums[2].
On 05/22/2011, University officials took the site down as soon as they
learned of it[3].
On 05/23/2011, UCSD issued an Statement on the webpage of Division of
Physical Science and also on the webpage of Department of Chemistry &
Biochemistry:[4]
An apology for insensitive comments on Professor Kubiak's research lab
website
On behalf of President Mark Yudof, Chancellor Marye Anne Fox, and the UC San
Diego community we are truly disappointed by the insensitive and offensive
language that appeared on the website of Professor Clifford Kubiak. This
language does not conform to our commitment to the UCSD Principles of
Community. We have communicated today with Professor Kubiak who has ensured
that the offending language has been removed and he will provide a formal,
written apology. This apology will be posted on Professor Kubiak’s website.
Further, we have asked the Office for the Prevention of Harassment and
Discrimination (OPHD) to review the matter. Please accept our sincere
apologies on behalf of the University.

On 05/24/2011, Kubiak posted a letter of apologies on his lab website: [6]
Please accept my personal and sincere apologies for the insensitive language
recently found on my laboratory’s website. I find the language offensive
and I am embarrassed by the poor judgment exhibited in posting the offending
language. Although I was unaware of the existence of this page until it was
brought to my attention, I accept full responsibility. I have taken steps
to remove the offending language and will arrange for appropriate training
for my research group and me relative to the UCSD Principles of Community.
On 05/25/2011, The World Journal reported this incident[7]. The World
Journal is the most influential Chinese-language newspaper in North America.

。他认为华人社区应该对于这样的歧视更加警觉,更多关注。他称过去华人对待歧视保
持沉默,导致遭受更多的歧视,因而华人需要站出来,保护自己的权益和名誉。而教育
界则应该对此类问题提高重视,加强管理和教育,消除对于少数族裔的歧视。
潘伟旋:努力伸张权益
潘伟旋表示,此类歧视华人的事件已不是偶发,对于少数族裔的歧视仍然存在,而
此番「权威人士」将其带入公众视野,则让华人社区更加清楚地意识到并确认了这种歧
视的存在。他认为这样的公开歧视行为让华人社区感到失望,也让华人看到种族歧视在
校园乃至社会中如何发生。但他认为华人群体对此次事件的处理十分恰当,使得校方和
教授本人很快地对不恰当的言辞作出了道歉。他也希望校方和Kubiak,不仅仅是道歉过
后便草草了事,而是确实地认识到错误并改正,同时努力消除种族及性别歧视。此外,
潘伟旋也表示,华人社区在日后对待可能发生的同类歧视事件也应该努力表示反抗和批
评,伸张自己的平等地位与权益。

这是我写的,供参考:
We are totally outraged by this racist incident, not only because of the
racial slur that it publicly displayed, but also because of its underlining
implication that the Chinese people are un-trustworthy and untruthful. This
is a racist slandering, because there is no factual basis to show that the
Chinese people as an ethnic group are more as un-trustworthy and untruthful
than any other ethnic groups. Questions must be raised that whether this “
Rule” serves to instigate racial profiling and racial prejudice against the
Chinese descent....This racist slandering has greatly damaged the
reputation of the Chinese as an ethnic group and may bring in serious
negative consequences/impact to the ethnic Chinese on campus and the Chinese
people in general within the
United States, that regards itself as a nation of democracy and equality,
etc.....
