发帖数: 1135 | 2 这个律师有点答非所问，“开公司”与“开公司雇用自己”是两回事。
F1当然可以在美国开公司，我的理解，只要你是地球上某个国家的公民，
你就可以可以在美国开公司。大致分两种情况，跟填税一样，Resident和
Non Resident。
说个侧面的证据吧，在美国成立S Corporation，其Share Holder不能是
Non Resident。言外之意，只要是Resident就可以成立S Corporation。
至于其它形式，连这个限制都没有。
很可惜，许多同学有不少好的想法，因为这个误想就白白的失去了机会，
其实到州政府的网页看看，或买本开公司的书看看，就一目了然了。问
什么律师，律师就是不懂，也要装懂。

这点内容在各种书上拷贝来拷贝去，老子都快背下来了。
很明显，你这个连接的作者自己都不太明白呢，原文拷贝如下：
ALL shareholders must be either U.S. Citizens or Permanent Resident Aliens…
Non-resident aliens are NOT acceptable
只要填过税表的人都知道，Resident与NonResident是两个相对的概念，
这位老兄把"Permanent Resident"与NonResident来相对，很明显概念不清。
也不知道他从哪儿抄来的，其实我在一些书或资料中看到过这样的说法，害得我
刚开始也以为只有公民或绿卡才能开S Corporation，但经过仔细研究，我认为
只要Resident就可以。请注意，是“我认为”，我不是律师，你要自己当真，
自己想办法确认去。

hehe, 笑死我了。
首先，以后不要把这些烂网站的FAQ当回事。
其次，这个FAQ正好证明了我说“在美国自己办公司、办H1、办绿卡”的说法，
原文为：For you to manage the corporation actively, however,
the corporation must petition for you to work for it.
言下之意，你想为你自己开的公司正式工作(成为owner-employee)，
要你的公司给你办H1。
这话说着容易，如果一个公司想办H1，想必有些条件限制，有时候我会去研究一下。
最后，为什么"It talks about H-1, but same also applies to F-1."?
你老兄的假设可是大有问题啊。 |

"Have only citizens or residents of the United States as shareholders; "
the notion of "NonResident alien" you mentioned is only for tax purpose only.
If you read your tax form instruction you can see that disclaimer.
