我的 non-compete 协议中，有这么一条：就是要在当地进行仲裁，就是说不上法院
当地律师的建议，就是我接受新的ｏｆｆｅｒ 有风险，原公司可能会告我，通过
arbitration 解决，而不是通过ｃｏｕｒｔ。
加州律师，觉得问题不大，感觉协议上面没有说的很清楚。
着急死了，口头答应了ｏｆｆｅｒ 但是一直没有签字，对方公司一直在催。
如果我去加州公司，对方通过仲裁，我败诉了， 这家新的加州公司会不会帮我出 ｌ
ｅｇａｌ ｆｅｅ？

“Any controversy or claim arising out of or relating to this Agreement,
shall be settled by a single arbitrator in arbitration in XXX City, XXX, in
accordance with the Commercial Arbitration Rules of the American Arbitration
Association, and judgment upon the award rendered by the arbitrator may be
entered in any court having jurisdiction thereof. The arbitrator's decision
shall be final and nonappealable" |

跟你的加州律师讨论下就清楚了
如果你的新工作跟旧工作没有任何关系，只是新公司在nca的list上面，旧公司告你的
胜算也是很小的，因为它没有损失。当然它跟你有仇就是为了告你而告你那也是没有办
法的，前面有人说了即使没有nca人也可以这么干

网上看了下，好像美国高院 好像是支持 non compete 通过仲裁来解决
如果是通过court， 他们应该是告不赢的 |
