Perhaps the most difficult part of drafting a labor certification is
preparing the minimum requirements for the position. The drafter must
consider not only the employer’s actual minimum requirements and the
foreign national beneficiary’s qualifications for the position offered, but
also draft with an eye to filing the I-140 petition. With the slow progress
