the above-referenced
residence. Pursuant to payments made and/or to be made by Farmers to Mr.
Goeke pursuant to
his home-owners policy of insurance, Farmers is entitled to assert claims
against any third parties
that are or may be responsible for the damages caused by this loss.
This fire loss occurred due to the failure of an HP KS526AA 12-cell multi
charge
extended battery sold by your company to a Mr. Leonard Griffin in February
2010. I have attached a copy of the order from Amazon.com. The battery was
attached to Mr. Griffin’s HP
laptop which was located at Mr. Goeke’s home at the time of the failure and
fire.
Although the investigation into the cause of this loss is still ongoing,
please allow this letter to place your company on NOTICE of a POTENTIAL
CLAIM for the damages caused by this loss. Please immediately notify your
liability carrier or any other entity that may provide you indemnity for
this loss. The principal purpose of this letter is to provide you and/or
your liability carrier and all other interested parties the opportunity to
participate in an inspection and examination of the evidence. Please contact
me so we may schedule the joint
inspection. |

护起来，当然运作成本也高了；小卖家咋办呢？惹上一次还不够赔的呢

如果不在，赶紧和HP联系，看看把他们拉上垫背。
如果在，看看能不能说没有收到letter或者email什么的。另外，如果你这种不是
authorized reseller,不知道应该怎么处理。

BTW,这也是种隐形的BSO.能卖出一个电池起火的laptop,那得有多大的销售量呀。呵呵。

火不一定是电池引起。索要一切证据，为什么咬定是电池造成的。对方检查时，自己要请自己一方的防火专家同去，不要省小钱。这是整个案子里胜负的关键。我猜测对方拿不出过硬证据 - 都烧个稀巴烂了。电池也许是被别的东西烧热后才出的问题。这里很有文章可做。找防火专家要通过律师，律师可以让专家得出你想要的结论。
即使是电池引起的，房主是否有疏忽，例如没有按照规定使用电池-电脑本身有问题，电脑软件有问题，把电脑埋在被子等通风不好的地方等等。有可疑情况后，房主是否采取得当措施？什么时候喊的911，还是自救？
索要其它损失的证据。例如烧坏的家具价值等。
拉卖电池给你的人以及电池原厂家下水。把这封信给它们。不知你有没有保留当初买电池的票据等。如果没有，只能拉厂家一家下水了（希望你卖的电池不是一个山寨小厂的）。
最重要的还是第一条。后面都是缓解措施。你在一开始越认真，对方盯着你的热情就越小，因为对方看到下面的路不好走。

在一起，质量不好就易起火，我们一般不用国产电芯来做这类电池。

1st, this battery is bought from HP and manufactured by HP. I don't think if
the ipad make my house fire, then I can sue Bestbuy and Apple together if I
bought from Bestbuy.
2nd, there are a lot of things still has to be invested. They have to make
sure the fire is from the battery and the batter is the batter you sold to
him. If there is no evidence such as S/N and invoice, how could they say the
batter is from you.
I think you need keep the invoice from HP.com for yourself and then talk to
a lawyer to see his suggestion. I think for consulting, you should not pay that
much. It could be either Free or $100 for a talk.
If you end up with paying something to the buyer, you can also sue HP for
their product.

问题，也可能是电脑的充电器或是内部充电电路故障引发的,这些都需要考虑。加上如
果是hp的原装替换电池，如果确定了是电池引起的火灾,理论上讲他们应该负责，而不
是楼主，所以之前在官网上购买的凭据一定要找到哦.

This is totally wrong.
If we assume the fire is caused by the battery, the buyer has valid product
liability claim against all the chain of retailers, distributors and
manufactures, who are jointly and separately liable for the total lose.
In your hypothetical, if the iPad catches fire, you can certainly sue
Bestbuy and/or Apple. If you win the case over Bestbuy, they can sue
Apple for the lose later.
Back to the battery case, if the buyer does file law suit against LZ, LZ
will probably need to get an attorney and join HP into the law suit.

若是我，我可能会写信告诉他们，不要浪费你的时间和律师费了，我不是HP的零售商，
仅仅是买了电池没什么用，转手卖给他的。你要找我，要钱没有，要命也没有。
我想对方未必有十足的证据能证明电池一定是我卖给他的。但一定可以确定那是HP的电
池。又没什么利益，未必会咬死我不放。 |
