经过咨询举证后确认，laomagua和skydive在MITBBS的行为已经违反了美国法律，
Internet Harassment Laws，关于Internet Harassment各州法律规定大同小异，因主
犯laomagua身在Massachusetts，以下是麻省的Internet Harassment Law：
Section 43A. (a) Whoever willfully and maliciously engages in a knowing
pattern of conduct or series of acts over a period of time directed at a
specific person, which seriously alarms that person and would cause a
reasonable person to suffer substantial emotional distress, shall be guilty
of the crime of criminal harassment and shall be punished by imprisonment in
a house of correction for not more than 21/2 years or by a fine of not more
than $1,000, or by both such fine and imprisonment. The conduct or acts
described in this paragraph shall include, but not be limited to, conduct or
acts conducted by mail or by use of a telephonic or telecommunication
device or electronic communication device including, but not limited to, any
device that transfers signs, signals, writing, images, sounds, data or
intelligence of any nature transmitted in whole or in part by a wire, radio,
electromagnetic, photo-electronic or photo-optical system, including, but
not limited to, electronic mail, internet communications, instant messages
or facsimile communications.
(b) Whoever, after having been convicted of the crime of criminal harassment
, commits a second or subsequent such crime, or whoever commits the crime of
criminal harassment having previously been convicted of a violation of
section 43, shall be punished by imprisonment in a house of correction for
not more than two and one-half years or by imprisonment in the state prison
for not more than ten years.

由于laomagua和skydive违反Internet Harassment Laws的违法行为发生在www.mitbbs.
com，MITBBS不可避免成为被告载体。以下几点作为MITBBS站方包庇和纵容laomagua和
skydive违法行为的证据：
1. 2012-11-16 laomagua在Complain版发如下帖子辱骂诅咒本人，当时即向站务
mitbbs投诉，站务没有回复，至今未对laomagua做任何处理。
就这一段。boston我跟你讲， 你空口污蔑那个killa是我的马甲， 如果是我他妈就死
全家， 如果不是你这辈子记住总有一个叫老马褂的咒你死全家， 一辈子当个不下蛋的
老母鸡。
2. 2012-11-19 站务做出弹劾X5成立的决定，但没有公布投票作弊主谋ID，并对作案ID
做相应的惩罚，直接导致随后以laomagua为首的iFun俱乐部成员对本人的人身攻击行为。
3. 2012-11-19 iFun俱乐部成员skydive在Photogear版发贴公然威胁恐吓本人，我当
即将该贴转到Complain版，并向站务mitbbs投诉，站务未做回复，删除了Complain的转
贴，至今未对skydive做任何处理。
4. 2012-11-28 针对laomagua的网络流氓行为，本人在站长工作室SYSOP递交了如下投
诉，该投诉证据确凿，标记受理至今已近一月，站方未对laomagua做任何处理。

5. 2012-12-7由于站方没有对严重违反站规的laomagua等ID采取适当有效的制裁措施，
直接导致以laomagua/Nikonshooter为首的photographer俱乐部对本人集体人身攻击行
为。本人在站长工作室SYSOP递交了如下投诉，该投诉证据确凿，标记受理至今近三周
，站方未对以laomagua/Nikonshooter为首的当事人及该俱乐部做任何处理。并对
skydive在站长工作室SYSOP所发标题为“恳请站务明确本站是否避讳ID的个人疾病医疗
状况”等此类严重违反MITBBS站规，对本人歇斯底里人身攻击的帖子标记受理。证据已
备份并转发警方。

6. 2012-12-14 由于站方对laomagua/Nikonshooter等严重违反站规行为的未按站规处
罚，客观造成对在MITBBS人身攻击行为的放任纵容，导致很多ID对本人恶毒攻击。看到
如下贴后，向站务mitbbs举报，并在Complain和SYSOP发帖举报，站务没有回复，并将
Complain和SYSOP的举报贴删除，至今未做任何处理。

首先警告laomagua, skydive。报警及备案调查范围不仅仅限于MITBBS，而是涵盖了IHL
条款中的所有范围，包括伪站。当然，如果你们不在乎加重罪行，尽管为所欲为。我无
所谓，只好乐观其成，虽然目前提供的证据已经足够。
其次警告众网络盲流。虽然你们对于随波逐流的执着已经屡次让我无语，但考虑到某些
不明真相的网友可能会受到牵连，明知道没什么用，还是提醒一下吧。报警备案之后，
我能做的只有补充证据，其他一切都不在我的控制之中，虽然只备案了以上两位，但不
排除警方在调查过程中决定对某些ID处以罚款的可能性。如果各位不想有犯罪记录，
奉劝各位谨言慎行，以免惹祸上身悔之晚矣。
好吧，最后警告tyning等热爱造谣传谣的ID，我保留随时报警控告你们的权利。
