1)07年在报税时已经可以算resident alien，可以用1040或者1040A。我家用的1040，
而且可以使用treaty。使用方法：在21项，填上免税收入，在这项的虚线上注明：
exempt income，treaty with China。
2) 07年你老公的收入应该全部免税，而楼主因为在美转的J1，应该不适用treaty。
3)
你们就直接更改去年的税表，把stimulus payment和child tax credit都要回来。
Stimulus payment，你家宝宝300，你和你老公能不能各拿到600，要看你们07年最后缴
不缴税，如果不交税，你和你老公各300.
4)你们家动作挺快的，今年也可以要回stimulus payment，不过今年叫”Recovery
Rebate Credit”在1040的第70项。计算方法和去年一样。
你们还是直接改去年的好了，今年的税表如果没有其他地方失误就不用折腾了。 |

差别在于每个人的观察力的细致程度和深度。
如此才能分辨是内部的stimulus还是外部的stimulus.
如果像一般心理学的观察能力只能看见外部的stimulus,
那么解决方案就不够彻底。
甚至变成一些外道的以“抗”和“抑制”来控制自己的反应。
所以高低水平的差别应该在于能否看见原始的刺激。
这个差别，可能是作者没有想到的。
但无论如何，顺着这条路练习观察力，应该是不错的。

换为J1签证.我们有一个在美国出生的宝宝,生于2007年4月16日,有SSN.
我们的问题是:我老公想当然的一直沿用1040-NR-EZ税表报税, 所以去年(2008)报税时,
我们没能拿到宝宝的child tax credit, 没能拿到Stimulus Rebate, 反而上交了一部
分联邦税.
今年我在本坛潜水多日, 觉得去年(2008)报税用错税表了,但我老公还是说我理解错了,
特向大家请教几个问题,谢谢!
1)去年(2008)年报2007年的税时, 我和我老公都可以视为resident, 所以可以用1040A
来报税对不对?
2) 我老公在去年(2008)报2007年税时还处于H1的三年免税阶段, 所以我老公认为应该
用1040-NR-EZ报税,否则按照resident报税就不能免税了; 而我觉得H1前三年的免税和
用1040A报税并不冲突,我们去年实际上可以用1040A报税,并且可以享受免税,对不对?

1）你是H4，应该没有ssn对吧，填1040或1040a上面的任何人没有ssn都不能拿到
Stimulus Rebate，我打电话问的irs
2）resident 填1040 或1040a 是不能享受任何treaty article的。虽然都说h1b享受前
三年免税，但是没有一个人拿出红头文件说明。很多人用这个方法免了联邦税，并说明
这么做是法律允许的，而是税务局的官员根本来不及细看税表。你想想，就那个几十个
人处理退税，只要不是漫天要价，他们都会给。至于采用那个方式，自己看着办。
3）如果填错了，可以更改，打电话给irs说一下就可以，我认为你能得到child tax
credit，但不能得到Stimulus rebate，除非你有ssn
4）一直沿用1040-NR-EZ是不对的，它是用于J1和F1，并且和8843合用。

1040NR,这次准备用1040。不过由于中美的treaty (36个月免联邦税和州税)，2008年只
交了Social Security tax 和 medical. tax. 不知道我们qualify stimulus吗？
另外，08年底，生了个小孩，也有SSN,能不能拿到stimulus?

stimulus payment last year. Since you received the $600/person last year,
you cannot double dip again this year.
On page 61: "You may be able to take this credit only if: You did not get an
economic stimulus payment" (for 2007 tax return).
So relax, you did not miss anything here. |
