To answer your question, if he is switching jobs under AC21 after the I-485
has been pending for 180 days, then he doesn’t need to have a new I-140
with the new company.
Any time you have an I-485 pending, you may request immigration to
adjudicate the I-485 based on an I-140 that is current. For example if
you have an I-140 that is approved for EB-2 and another for EB-3, whichever
comes up first I would request immigration to approve it based on that I-140
. The trick is to get immigration to pull the case out and approve the I-
485 based on the EB-2 (instead of EB-3 used to file I-485).

EB3, 我曾经跑了一次Infopass因为我的case在TSC，而且班花以前的帖子有说TSC系统
性错误。可是就是Local office 也查不出。后来议员的回复是这样的
The I-485 applications were based on the approved I-140’s ,LIN XXXX as a
2nd preference and LINXXX as a 3rd preference, both with a priority date of
5/2/11.
At the time of the initial inquiry, using the January Visa bulletin, the
individual could only adjust under the 3rd preference since the priority
date was 5/2/11.
At the time, the State Department was using the dates for 2nd preference of
February 1, 2010 and 3rd preference was 3/1/11 so there was not a current
visa to process the I-485’s.
Now that we are in the month of February, the 2nd preference is using the
dates of 3/15/10 and the 3rd preference is using the dates of 9/1/11 so
there is a current visa available to process the I-485’s under the 3rd
preference. The FBI fingerprints and name checks are current, so I have
requested the files from the file room and once I receive them, I will
assign them to an adjudicator to review and process the I-485 applications.
所以是否就让议员狂催，不管哪个catergory current都可以呢。至少我的case，
USCIS倒真是尽心尽力的两个catergory都看呢, 还引经据典的看了两个月的排期。 |

第一段我觉得就是在阐述485 pending 180天换工作情况。
第二段就是在说同一公司同时有2，3类140，又有pending 485的情况。。 |

第二段在说你到新公司又有两个140并且交了485的话，哪个快link哪个140.

I thought if you had switched the job, even you have two 140s approved, you
stucked in the categroy that you have submitted 485 with, in our case (
degraded EB3).
I have used my EAD obtained from concurrent filing under EB3 category to
switch to another job, are you saying that I can still relink without
restrictions???
This just changes everything....

发帖数: 8388 | 10 为什么不可以呢？ AC21 说 485 180天之后，只要是相似或者相同工作，140 remain
valid。对于降级的人来说，他们的2,3 类140 是基于同一个PERM的。一个有效，另外
一个应该也有效。
既然140 valid，当然可以选择2 or 3。

Pursuant to AC21 § 106(c), the approval of a Form I-140 employment-based (

发帖数: 4152 | 12 看来我之前想的是对的，485并不局限于哪一类，不论是哪一个类别下提交的，只要有
485 pending 180天，换了工作，之前公司提交的2，3类可以无障碍relink。
这对很多降级换了工作的是个很大很好的消息，只是还需要有人确实的验证下。 |

４月份递交了ＥＢ３ ４８５（用旧的１４０）。
可以用旧的同样的１４０relink回ＥＢ２吗？
