怨我租房期间父母住在里面,违约了。问题是
1. 我第一天就跟他说过了,而且他们也答应了,亏在当时大家都很随便,没写在合同
里面。(这是教训啦,后来人记住了。)
2. 他来看过几次,父母都在,他从来也没说啥。
3. 之前来回争执deposit,他争执的点都不是我不同意扣钱的点。 也没提起这个,
所以请教一下,如果打起官司,这个会不会是问题导致法庭不支持我要回400块钥匙钱
的诉求,甚至更多?

check if they still have that now, you can ask question and get help.
Everything is according to your contract, and written proof. I think usually
the contract will say something like no overnight guest. However he can't
prove that if you deny.
These are two separate issues. If you break the contract with overnight
guest, he can ask you to leave (or other measures in the contract). But
deposit is a totally different issue, landlord has to give you receipt
within 10 (?) days after you leave, and needs to take into account of
reasonable wear and tear, for example, if the carpet is dirty in one room,
he can't change the carpet for whole house.
I used to have some issue with landlord and went to small claim court, the
landlord immediately settled with me before I file the claim.

如果房子有官司,那么他卖也难吧。
并且,法律上规定他需要退deposit in 21 days.

deposit,就可以去small claim court去告房东,在美国要不怕麻烦,敢于争取自己的
权益。 |
