本人买车新手
第一次买新车 敲定是subaru 2015 forester
车子有3年 36,000mile warranty
dealer然后说“每6000mile要maintenance，然后30000mile的时候保养会很贵，总共到
36,000mile保养要3000多，subaru知道这钱很多所以出了个pre-paid maintenance
agreement总共花$1126+后续买新车$500 discount+$500cover旅游时候车坏了的酒店费
用+还有一个优惠$500，就是号称省钱保养嘛！
小弟回来想了想也问了些朋友感觉新车貌似没必要买这个，基本不会有什么问题。
dealer之前还说7年/100,000,extend warranty,我果断拒了。
请问版上有经验的朋友怎么看，是不是没必要买这个pre-paid maintenance agreement
。以前也没开过subaru的车，不知保养是要很注意什么吗？
请问如果自己按时另找店保养大概花费是多少？

我现在在一家公司做analyst，H1B，最近有点想换个公司，但是进公司的时候签了一个
Non-Disclosure, non-competition agreement。这个里面有一条好像是说离开工作的
一年之内，不能到直接或间接的竞争对手那里工作。
但是作为analyst，技术上面的东西不多，换工作的话，肯定是相同行业的比较好找。
公司有个同事跟我说，这个东西对有绿卡或者国籍的人没什么影响，公司也不会去找律
师告的。而且公司很多人就是从竞争对手那里挖过来的。
但是如果像我这样的H1B，如果想换同行业的工作的话，这个agreement会不会对我有影
响？具体说，HR可不可以因为这个东西，不transfer我的H1B？

事情经过：
我在华盛顿州，准备从一个小公司跳槽到一个大公司。给了小公司一个two-week notification
后，只过了一个星期就被let go了。小公司并且威胁我说，如果我加入大公司，会用Non-
Competitive Agreement告我。我当初因为只有一个offer并且要赶4月份h1b，所以就签了NCA(其
实那时候也不知道有这么严重，第一份工作啊）。关键是现在我并不认为大公司是小公司的
competitor，而且我就是小公司里的一个小小software engineer，小公司如此兴师动众也是我意
料不到的。一不小心就变成李开复了。
各位兄弟姐妹有建议的请不吝赐教，有经验的请多交流。有什么律师能帮我evaluate我的case的

通常好的代理，是在带你看房后且你觉得要下offer时，才会让签一个Non-exclusive

虑一下。我们这里规矩可能和别的州不是很一样，比如板上说的rebate我从来没有听说
过有人拿到。不过看了agreement我觉得有两点实在不合理，希望和大家交流一下：
1. buyer's agent会收取至少3.5%的费用，如果从seller那里拿到的小于3.5%，我们要
补给他差额。
这么说，如果卖房的只交了5%或者6%的手续费，我们就要自己补给agent 0.5%到1%的钱
？？这种情况可能吗？
2. 我们要额外付给agent$500
不是已经收了卖方这么多手续费了吗？怎么还要找我们收钱？？

人签字。
1.如果我们是个人与个人之间签，有没有什么格式或者特别注意的吗？需提供是么个人
信息以示身份和identity在这个agreement上呢？
2.有些条文如"EXPORT CONTROL LAWS"有必要包括吗？还是删除？
3.我看条文一般都是general,有什么条文是因人/情况而异需要特别注意但容易忽视的

因为是技术型公司，可能的竞争也很大，
公司很快会要融资，所以公司强烈要求每个人都签这个non-compete agreement，包括
CEO自己，公司主要是怕我短期内被竞争对手搞价挖走，现在本身在给竞争对手（大公
司）接洽技术服务，大公司的技术太老了，明显不如我们的性能。
虽说我死活不去，他们也没辙，过度的拒绝好像不是很好，
想争取的是，不管什么原因，离职的时候如果公司要求我履行non-compete agreement
，那么要求多久就付多久的工资，
另外，如果公司出现运作问题，不能按期支付我工资，那么non-compete自动失效。
再就是地域把中国除外，大不了公司出现变故啥的，还可以海归，
不知道，各位简易我还要求点什么？

把你限制成整个行业的公司和客户你都不能去工作，那就要商量商量。如果只是针
对具体公司和客户，签了吧。
如果你在加州，恭喜你，放心大胆的签吧。因为这个东西在加州屁用没有。
如果你做contractor，而最后也不得不签，建议你就跟公司说可以签，不过需要
附加一句，something like the non-compete agreement is invalid the day
xxx company is 1 day late with payment. |

disclosure的协议，B公司就把他的资料转到了法律部门，现在在要求他律师的联系方

发帖数: 69 | 50 有一年Non compete Agreement，现在Manager做事非常的不公道。很难换到别的领域。
是不是做一两年博士后，就可以绕过Non compete Agreement，或者有什么更好的办法
