一般大家的认知是：只要批准的140没有欺诈（fraud or willful misrepresentation
）都可以保留PD。
我查了一下USCIS的有关法律条文，与之相关的是以下两个文件：
第一个文件是09-12-2006发的Field Manual，这个文件陈述了I-140表格上具体审核的
每条内容，是指导具体处理申请的移民官如何审核I-140的工作手册，甚至涵盖了申请
人有可能欺诈的地方，大家有时间可以一字一句研读一下，下为链接：

俺昨晚又 brainstorm 了一下，DOL 如果真的把全美整个儿的保姆市场（不仅仅是月嫂
）给全灭了，会发生啥？
（当然版上的某些蠢货们多半开始敬仰 DOL 的威力，高呼 DOL 威武。。。蠢货就是蠢
货，不能指望啥）。
如果全美保姆市场被 DOL 全灭，俺第一个会想到的多半是，美帝联邦宪法的 the
commerce clause (Article 1, Section 8, Clause 3 of the U.S. Constitution)。
会不会抵触（其实主要看一堆狗屎判例），俺这个小瘪三哪里能晓得。但是俺小瘪三也
知道，高院万一大吼抵触，大伙儿统统洗洗睡了归零吧，CFR / USC 文字咋玩都是屎。
另外，万一被院长吼"抵触"，DOL 秘书长（注意，是带"长"的哦）会不会顿时觉得胸口
赌得狠慌狠慌。不知道。

美帝法律本身很复杂。是不是有漏洞可攻击很难说。但是不值得为这小事花精力
是真的。低收入者时间不值钱，闲着也是闲着。但马工显然不是。
另外就是月嫂市场本来就是有缝蛋，你拿一个有缝蛋的 case 去打，估计
成功率也不行。
不过单单就理论探讨，brainstorm 法律而言，且不说一大堆判例。单单就
法律条文字面本身：
（1）29 CFR 552.106 相对于 29 USC 213(a)(15) 的字面（companionship
的定义），也不一定就是那么肯定到了理论上滴水不漏的地步。（是不是有判例，
俺不知道，懒得查）。
（2）另外 DOL 是不是存在一点点过度执法的可能（判的钱稍微多了点？），
是不是可能影响 fair market，有没有可能触及联邦宪法的 the commerce clause
(Article 1, Section 8, Clause 3 of the U.S. Constitution)（具体要查判例）。

另外 CFR 偶尔发生没有 implement USC 的全部细节，那就要看（法庭）如何
解释 USC (United States Code) 了。
有没有好事的去读对应的 USC 的条文？同一个 section 里面。。。俺不行了，
俺先干正事去。。。

应该没事。
29 USC 213(a)(15) （以及相关 CFR）里定义了：只要是 infirmity，
算成 companionship，一路开绿灯给 exempt 掉。
前面有某大妈拿早产儿智障儿跟普通健康儿类比，来争论。看清楚了，USC
（是 Statue 级别的）里面白纸黑字写明白了要区别对待的：
（babysitting 要求 “casual basis” 才能符合，companionship

加州的民猪党其实钻了一个空子，就是应该用总收入determine non-exempt还是exempt

I called CBP at Vancouver (at airport), 接电话的人开始说single entry不行，后
来说，好吧，CBP总部说可以就可以，

人也说should be fine.但是他也告诉我，这个号码只是给arrival by airplane的。

许多美国的中国问题专家前来旁听。他们都关注这些与中国领导人打过很多交道的政治
家如何看待习近平的领导风格。
美国前驻华大使洪博培：习近平有“前所未有”的领导力
洪博培率先发言。他认为，习近平在最近几位中国最高领导人中，最像毛泽东或邓小平
。洪博培说，习近平正在相当大程度上展示着“前所未有”（unprecedented）的领导
力风格，以相当“单边的、进取的、自信的”方式领导。他在规模较小、想法更相似的
中央政治局常委的促进和帮助下决策，并且借助一些务实的前省长，有意推动经济改革。

上，今年最有可能成为债务危机之年。
从政府负债、居民负债再到企业负债，中国的整体负债水平在前两年不断上升。这使得
中国的经济成长真实性存疑。在扣除了债务、坏账等等各种水分后，中国真实的经济增
长是多少，答案恐怕将会远低于公布的数据。
在庞大的整体债务当中，直接关系到就业和经济成长的企业债务是非常重要的一环。如
今，很多的迹象都表明，中国的企业债务，已是走到了危机边缘。
一、债务掩盖了中国的真实经济数据
最近，官方公布了央企运营情况的发布会。据发布会披露的资料，截至去年末央企平均
资产负债率为66.3%，同比下降0.4%，其中62家企业资产负债率比上年下降。在未来两
年内，央企计划将平均负债率再降低两个百分点。
单就这条消息来看，貌似是传递了积极的经济信号，至少央企的负债在下降。但实际上
，如果我们进行一些简单的比较和分析，就不难看出中国企业债务的整体格局非常严峻。
企业要负债，其前提就是进行大量的过度投资，而企业投资的剧增，则直接与宽松的信
贷政策有关。
