I searched all the Indian websites and found an interesting fact:
1.) Most of the PD 2007.07-12 received their NVC notice around April 9th,
around the May VB release date.
2.) Most of the PD 2008.01-04 received their NVC notice around May 13th,
around the June VB release date.
My conclusion is that:
1.) Mr.O noticed the huge EB1 spill over in April, but he was afraid of the huge
EB3-EB2 upgrade, so he only told NVC to send notices to 2007 PD.

主要对CP的E3和EW研究了一下，对奥本去年和今年的排期有了一些解释，去年年初3类
排期一直在08年、09年时主要是针对CP中的E3，解释如下：
FY2010：
3类排期2/22/2002-10/22/2003；
CP E3一共绿了1922个02年、03年PD的CP，即-1922；
NVC公布的11/1/2009前：7122个CP E3在等排队；
CP E3新增加1524个2010年PD的CP，即+1524；（计算：6724-（7122-1922））
FY2011：
3类排期11/08/2003-7/15/2004；
CP E3一共绿了1088个03年、04年PD的CP，即-1088；
NVC公布的11/1/2010前：6724个CP E3在等排队；
CP E3新增加555个2011年PD的CP，即+555；（计算：6191-（6724-1088））
FY2012：
3类排期8/8/2004-12/15/2005；
CP E3一共绿了1022个04年、05年PD的CP，即-1022；

I had sent the fee bill to NVC through express mail. The recipt says that it
was received by Mr. xxxx at US BANK. The zip code is the same as the
National Visa Center St. Louis.
Let me check 2 things with people who have already sent their fee bill to

联系领事馆，具体面试是领事馆来操作的，和NVC无关。我这些信息也是通过另外一个
走824和follow-to-join的朋友处得知的。你老婆折你去那个国内移民签证面试的话，
还是要尽量让她看一下申请材料和824上的信息内容的，保证领事馆人员面试时可以回
答上来，一般面试问题都很简单，都是按照填表格上的内容来问的，其实就是让你确认
回答一遍，所以不用太担心。
顺便再问下，你那边申请824以后一个月就批准了，然后需要自己联系NVC吗？还是直接
等NVC发材料通知过来呢？从824批准到NVC发通知过来，中间大概要等多长时间？谢谢！ |

发帖数: 2904 | 7 NVC是Department of State的部分，是为走海外领事馆的绿卡申请人服务的，估计你的
NIW批了以后，case就从USCIS转到了NVC。也就是说绿卡第一步140是USCIS处理，第二
步，选择485的仍然是USCIS处理，选择CP的是NVC协调海外领事馆处理。
case 转到NVC，有可能是USCIS的失误，也有可能是办NIW时候的140上面，processing
information那块选的是境外领事馆处理，也就是走Consular Processing，CP程序。如
果境内的话一般就选的是Adjustment of Status，AOS，也就是交I485转换身份。
因为对于中国大陆出身的人来说，NIW有排期，所以有的律所，比如wegreen，会建议申
请人在140那块选择境外CP。这样做的好处是既可以在境外走CP，也可以在境内走485，
比较灵活。
我估计是你们排期到了，NVC主动跟你们联系了。不知道当年办NIW的140还在不，要是
还在的话，可以看看当年是怎么选的。
一般的话，可以给NVC写个信，说你们在美国境内了，想走485 AOS的程序，请求把case

首先，140批准后USCIS会把全套材料转寄给NVC（大约1个月时间）
接着，NVC会给你发来书面通知已经受理，你需要在30天内回复转USCIS AOS或者缴费（
不回复也视同NVC处理）
缴费后就正式进入NVC waiting list，否则只会保存材料等待USCIS发出请求后邮寄。
注意，申请NVC处理的140，如果PD Current后1年内不递交申请，则140会被作废，这就
是之前版上有人说PD Current后1年内必须递交的来由。AOS反而不受这个限制 |

马上要给LD交F2A的485了，今天整理所有材料时发现去年有一封从US Dept. of State
National Visa Center (NVC)的信，大意是我们收到了你的移民申请然后可以去哪哪办
移民签证，还给了个GUZ(广州？）开头的case number。刚开始还紧张了一下，为什么
会收到这信？因为我给LD交130表上第22项确认relative is in US and will apply
for adjustment of status明确有写向Chicago递交485；没写要去广州签证啊。
仔细一想，这个是dept. of state NVC，不是USCIS。所以我的揣测是只要USCIS的130

返回，还是说直接把你的材料返回？ 因为律师说 我也打电话确认了，uscis说他们会
自动联系nvc 要求返回材料，说如果再联系nvc，nvc自己返回材料的话 会造成confuse
。

结果得到的回复很少，在为数极少的回复里也是寥寥数语。我现在是在485 pending.
老婆现在在国内，就盼着赶紧绿卡下来可以给她申请，就是用follow to join的方式。
前一段时间在网上搜集了一些相关的资料，在这里总结一下。希望对有这方面需要的朋
友有所帮助，也是为了自己能理一下头绪，为今后的申请做好准备。即使是要找律师，
也不要被律师给忽悠了，先做到心中有数。

DOS之间的关系。
举个例子：
比如8，9月剩下13000名额，其中USCIS可以批准的demand只有10000，那它只能获得
10000，剩下3000归NVC(发放到海外大使馆）。如果NVC根据它的数据发现海外大使馆到
2009年1月1日总共才有3000个demand,那最后9月的排期就会到2009年1月1日，虽然美国
境内的AOS总共才有10000人而且不能批准最新递交的485，但是海外大使馆会用掉剩下
的名额，剩下的越多，排期前进的越多。等新的财年开始，就又根据AOS 485数量回调。

美国调整身份（不论成功率如何）， 那他就跟485有关， 你的情型不需要考虑485。
130递交后你会先收到一封信， 移民局告诉你已收到申请（但不等于批准申请）， 若
干时间后（可能是几个月， 也可能是数年）， 移民局再发一封信， 称已批准你的申
请。

第二步
被批准的I-130会直接寄往美国国家签证中心(NVC), 然后再寄往美国驻广州总领

填完发NVC,NVC处理大概需要4周左右，处理完NVC会发给广州领事馆,安排面签,到你收
到面签通知,这个过程可长可短,短的估计一到两月,长的3到6个月.

consolidate到我们现在的485，他们用的专有名词是consolidate，都不用relink什么
的。现在这个SR还没有回复，要等几天。
同时我们也写信给医院，让议员帮我们问，议员的回复是，到时候会有人把我们的case
调出来看一下，说让我们不要worry。
第三个就是在网上的E-request那里选了case out of normal processing time,然后表
格选的是140，然后输入我们1A的140，然后在last action on your case里面，我们输
入了以下这些话

是材料可能会中美之间往返邮寄），造成最后485拖几年不批。
我办事求稳妥，所以直接写信给NVC，要求把Case转回USCIS，等收到NVC信确认Case被
hold等待USCIS领取后才考虑交485。
虽然前期晚了2个月，但是换来后面的处理速度，我觉得值
我的时间：
12月底书面请求NVC
2月初NVC回信确认
2月中计划交485 |

2. Case Completion Notice- 告訴你NVC已經完成審核工作了

Jan 2018: 领事馆面试，当场通过
次日 Visas are issued.

I don't think that anyone outside of the State Department has a clue as to
future cutoff date movement in the short term. There are just too many
unknown variables. Perhaps the best indication is the interval we see
between when the NVC sends the fee bill and the individual's priority date.

注意：如果外籍配偶在美国境内等待绿卡，在等待绿卡期间必须一直保持合法的非移
民身份才行。等待排期这段时间，移民局是不会主动给外籍配偶合法居留身分的，所以
外籍配偶必须自行以其他非移民的合法签证留在美国，如F1、H4等。如果非法居留，是
无法在排期到时在美国提出调整身份的申请。
如果外籍配偶以观光签证来到美国，不建议立即递交移民调整身分申请，否则会有移
民欺诈嫌疑。同样的，在美等待排期时外籍配偶需维持合法身份。
A. 情境一：配偶在美国境内
分为两阶段送件：
①绿卡持有者为外籍配偶递出I-130亲属移民申请
I-130 (外国人亲属申请，由绿卡持有人填写，说明彼此婚姻关系）
I-130所需准备文件：申请费用$420支票；绿卡持有人与配偶的G-325A表格，各1份；绿
卡持有人的绿卡正反面影本；绿卡持有人未过期的护照影本；结婚证书；双方真实婚姻
关系的证明文件，如照片、共同资产、银行联名帐户等；绿卡持有人与配偶的护照规格

too early will cause NVC to start the process early, and you can only
postpone one year for CP. If NVC waits more than a year, they can close
your case which means although your approved I-130 is still good, you need
to file I-824 to start NVC process again. That's >$300 fee for I-824. |

will revceive a copy of NVC letter if his address was correct in I-130.
The other letter will go to the lawyer (your representative). So in this
case it's normal you don't receive letter from NVC, because you have a
lawyer. But your father (who cannot have a lawyer until NVC letter) can
show you a letter and determine whether he wants a lawyer or agent for his
case (only he can give the consent). |

you select that one on your I140 form?
现在看到我们的notice上有句话，但我不太明白，原文是：The above petition has
been approved. We have sent it to the Department of State National Visa
Center (NVC), 32 Rochester Avenue, Portsmouth, NH 03801-2909. NVC processes
all appropriate consulates to complete visa processing. the NVC will then
forward the approved petition to that consulate.

3个前说是把母亲的资料寄到广州大使馆，父亲的说是i-864表添的不对重新填写。我就
奇怪了，一样的填写，怎么母亲的对，父亲的不对。不管如何，说是不用把i-864寄到
NVC，父亲面试带上就好。
可是三个月都没受到面试通知。那个NVC的电话也打不通，发邮件给NVC，一个月后才受
到回复，说是和广州大使馆联系。
大家谁有类似的情况呀？
广州大使馆如何联系？
我知道可以google,如果有类似情形，可以参照一下。

发帖数: 359 | 44 现在f2a排期确实是2014年4月，那么估计半年以后你的排期就到了。我好久没看visa
bulletin，还以为是2013年呢，不好意思。
你老公当初给你申请130的时候，选的是adjustment of status 还是consular
processing? 如果选的是adjustment of status，那么他现在需要递交824申请，把你
的case从uscis转到dos下属的nvc，等你排期到了，nvc就会通知你去广州领事馆办理移
民签证。如果你130选的是consular processing，那么现在什么都不用做，排期到了
nvc会主动联系你们的。然后就是回国去广州大使馆面试，再然后做601豁免。。。。。
。601豁免完全case by case，针对性很强，我很难泛泛回答你，你最好去问一下律师
。以上就是靠着你老公的绿卡拿你的绿卡的做法。
换一个角度说，你老公明年入籍然后upgrade to ir1是解决你身份最快也最保险的做法
，你不需要做824，不需要回国，也不需要做601这些繁琐的手续，你们好好商量一下吧

140 approval notice (I-797) 上却写着要consular processing:
“The above petition has been approved. We have sent it to the Department of
State National Visa Center (NVC)... NVC processes all approved immigrant
visa petitions that need consular action. It also determines which consular
post is the appropriate consulate to complete visa processing. The NVC will
then forward the approved petition to that consulate.”
我记得之前交的140表格上选了在美国调整身份
这种情况正常吗？有人收到类似的approval notice吗？ |

当初填140的时候选了CP，因为会回国签O1，怕被拒绝. 现在已经在美国了，想直接提
交485。网上考古了挺长时间。看到一些移民网站说可以直接提交485. 板上也有人说过
直接提交485没问题。但是也看到有网友说最好等待NVC把case收到以后，我再联系NVC
让他们转到USCIS。然后再提交485.可是这样就会浪费两三个月。这实在是浪费不起啊
。大家有啥经验吗？我可以最近直接提交485吗？还是还真得慢慢和NVC USICIS把这些
事情理顺了。
问题可能比较弱，大家不要建议。谢谢！ |

早在3月，我就注意到此事， 我发现DoS公布的demand数据和NVC waitinglist的总数据
（按国家分，但是没有按PD年度区分的inventory)有较大出入，由于我坚持FY2010
下半年的游说合同条款必须有一些数据厘清查证的要求，游说代表在合同签约时也同意，
所以，在5月-6月之间，我一再要求游说领导层把我的要求（就是厘清NVC waitinglist
的inventory）反映给游说代表，让游说代表找老奥和NVC问问清楚，以利我们EBC分析
，结果被游说领导层采用粗暴手法一再阻拦，而这些游说领导层对游说代表在FY2010下
半年的游说合同期间采用“养士”式的处理方式，游说代表在整个下半年的游说合同期间的
主要工作就是排期公布后发email给我们游说组，加起来6，7个email, 已批数据还拿不全，拿走9000刀，连大多数游说志愿者都承认游说工作处于瘫痪状态，我对此很无奈，我没有直接和游说代表通话的权利，只能通过核心层传达，我数次建言被核心层阻挠和打回，我只好在6月宣布离开游说组了。
