边境的时间就太晚了，已经进入深秋或冬天，开始下雪了。
好多人其实没有真正走完PCT，走了路程的 98% ，但最后一段靠近加拿大那边已经
下雪，无法再走了。 |

日前，世界知识产权组织（WIPO）公布消息称，2017年中国提交的PCT国际专利（专利
申请人通过《专利合作条约》途径递交的国际专利）申请量达48882件，排名全球第二
。在PCT国际专利申请量前15位的原属地中，中国和印度是仅有的两个中等收入国家。
“从世界知识产权组织公布的各项数据可以看出，中国政府和企业越来越重视知识产权
保护。”大连理工大学知识产权学院院长陶鑫良表示，知识产权为中国发展成世界第二
大经济体提供了重要支撑，也成为中国企业走向国际市场的竞争法宝。

The 7.5 pct return u referring to is probably the annual price gain of tlt,
plus it's dividend over the course of 10 year period. That was cuz the yield
was much higher than the current 2.75 pct. And then pple go into
treasury, and take the price of treasury higher, and take
the yield below 3 pct, and price of tlt rally, by maybe around average of 7.

在陈安博文后贴过，但我觉得很有用，特此再贴在下面，以便让更多人读到并受益。
作为个人（或自己的小公司来说）申请专利是为了把自己的专利卖给大公司，全世界没
有一个小公司或大学有能力把自己开发出来的新化合物从头做到尾（尾就是拿到生产销
售证书）都是做到一定阶段后转让的——licensing。所以一个真正想转让自己发明的
可能新药的人不会去追求专利的申请，而是追求专利的批准。我国现在科技人员中用申
请专利数来评判的做法是胡闹。
下面讲讲如何申请专利才能获得最大利益或减少损失到最小程度：
1. 在适当时期，先把中国专利申请（能保住密，申请得越晚越好），过去的申请费用
在6000元左右，现在是否涨到1万元以上我不知道（我后面讲的费用都是10年前的行情
）。
2. 在中国专利申请快要满一年时，申请PCT。如果不申请，你的专利满了一年后，就永

1.PCT只是一种向外国申请专利的途径。其不代表你的发明在全世界范围内获得了保护
。无论你想在哪个国家获得专利保护，都需要单独的递交申请，通过巴黎条约，PCT都
可以。如果你在中国申请了专利并获得授权，则只能在中国获得保护。虽然你同时申请
了PCT，其只是把你向其他国家递交申请并要求中国优先权的时间拉长到了30个月或31
个月，视不同国家而定（自中国优先权日起算）。如果你没申请PCT，则需要通过巴黎
条约在12个月内完成向其他国家的申请。
2. 如果你在美国递交了专利申请，并申请了PCT。如果你不通过PCT进行国家阶段的申
请，你将来可能获得保护的也只有美国。

成员国都有约束力，但最后会要到一个具体的国家变成真正的专利，所以不存在国际专
利这种东西。假如是PCT appl的话，应该会有多个号码，对应多个国家。因为还是申请

川普以迅雷不及掩耳的速度，封杀博通并购高通案，是美国政府史上第四件仅见以国家
安全为由封杀外资并购、也是美国政府史无前例的在并购案成局前、即出手封杀的例子
。虽然川普出手之快、之绝，出乎大家意料，但回顾历史，美国政府对关键科技的国安
审查，并非始于今日。
笔者早在四年前，即曾为文探讨，中国华为公司想进军美国，为何踢到铁板？最主要的
原因，就在于美国政府认定，关于华为这家神秘的公司，大家都知道的太少。2012年的
《纽约时报》曾指出，美国众议院对华为和中兴两家中国公司的报告中认为，由于华为
和中兴与中国政府关系密切、中国政府大量补贴这两家公司。
报告称，如果允许这些中国公司在美国从事商贸活动，将会使中国政府有能力轻易截取
通讯内容，对美国重要基础设施发动网路攻击。固然这些内容只是推测，但显然除了这
些公司的产品可用、价格便宜，至于其他的部分，美国政府找不到答案。而找不到问题
的答案，就成了是华为最大的问题所在。
回到此博通提议并购高通案，关于此并购案的国安议题，除了众所关注的：博通总公司

Aardvark Express。为了写这个专门查了一下，原来这个A啥的是非洲食蚁兽。
我第一次去是朋友推荐的，进去的时候问店主Dan，“你这地方开了多久了？”，答："
在这儿三年了“。 我又问”生意怎么样？” 答：”在这儿三年了“。
味道确实不错，每次经过只要这地方开着就去那里去吃。冬天当然滑雪的顾客很多，夏
天没那么多人，来爬山骑车的游客和修路的工人。到了七八月份的时候，从墨西哥边境
沿PCT步行向加拿大边境进发的长距离健行的thru-hikers也会陆续到达，他们会在加油
站取自己出发前寄过来的补给包裹，也会在这车里买一份午餐或晚餐。
我最喜欢的是Hurry Curry Bowl，咖喱饭配一块菠萝蛋糕，强烈推荐。
哦，还有，有位中国女孩今年正在走PCT，全程2663迈。她四月份从墨西哥边境出发，
走了两个多月现在已经到了北加，昨天刚刚过中途点，预计九月初到西雅图，到时候应

作为专业的专利律师我都说过了，以下情况专利律师可能会建议申请人放弃最先递交的
国内专利而从PCT反入国内：
（1）申请人的国内专利申请递交十分紧急，导致有不少材料需要补充，以至于原来最
先递交的国内申请没有继续申请的价值；or
（2）某些专利申请，按照PCT的专利规则比按照国内专利法操作更有利；or
（3）曾递交了多个国内申请；or
（4）其他各种神奇的情况
中国又不是美帝，天朝从来就不是专利申请这块的大市场，无数国内公司申请中国专利
的根本原因就是为了递交PCT。
不仅中国，很多发展中国家都经常走这个路线：国内申请递交-PCT递交-转入美帝、欧
盟各国、日韩。至于自己最开始本国的那个专利……who cares？

year of you own publication.
If all you want to do is to postpone the time you file a US patent while

of your publication, then file a PCT claiming priority of this filing
