opinion好了，可以告第一个malpractice。在这儿都是业余的，说了也做不了准，你也
不可以告我们啥的呀。
H1其实就是一天grace period都没有的。如果你被lay off，原则上就是out of lawful
status，不过一般可以跟移民局argue以I94上的日期为准。L1我不清楚。
还有就是out of status和unlawful presence是不一样的，你即使out of lawful
status，也不算unlawful presence。
移民法是国会最大，大部分东西不是硬规定，是移民官看着办的事情。 |

Interview当天我们到的比较早，开始警卫不让进去，我说我们需要用厕所，因为开了2
个小时来的。他们就让我们进去了。然后妈妈在厕所里面换衣服，化妆。出来后我们就
在门口的椅子上等，他们也没有赶我们出去。后来快到预约的时间，警卫就让我们进去
了。
在里面又等了很久，一个女的移民官来叫我们进去，让我们把东西放在椅子上，然后举
起右手发誓。要了我们三个人的ID，然后就开始翻材料问问题。
问了妈妈的名字，生日，现在的地址，就是女儿家的地址啦。然后就问当时签证来的时
候有没有打算留在这边，妈妈声音很小，因为没有准备这个问题，她大概也不知道怎么
回答好。翻译听成“是打算留在这边”。把我急坏了，可是也不能插嘴。我就给他使了
个眼色，然后对移民官说，I don't think she get it, could you ask her again?
移民官又问了一遍，他们终于把这个问题给答对了。

妻子可以申请转换，这是可以的，符合法律上的定义与逻辑。
这个就是AOS的定义所在，假设递交485是在H1结束后，那H1到485file这段时间是黑了，
毫无疑问。 而485赋予的是automatic lawful status, 所以是不会被追溯的。 追溯发
生在485被denied 之后MTO期间。 举个例子，
假设LZ 08/30 之后被雷，身份即可失效。 LZ 在09/30file了140/485，那么08/30~09/
30这段时间立刻属于illegal status. 而09/30之后是lawful status, legal stay. 假
设485在12/30号被拒，那么这个unlawful stay,仍然只是~09/30，后面的不黑。而
LZfile MTO，那么unlawful stay从denial那一刻起开始clocking. |

移民局又开闸了，于是大伙儿全来趟这浑水。不管是 140 还没填的，抑或是 pending
的，更不要说批了的了，尤其是七月二号没赶上车的，大家一齐冲向 485 高地。
485 填表战，又开始了！
有的同学过于紧张，简单的问题也不敢把握，向白老师 (xiaobaitu, 呢称 XBT, 又称
小白兔 JJ 或 小白兔 MM) 求助的贴子是满天飞呀！就象北京春天的柳絮。
老师和系主任咬过好几次耳朵，建议挂个咨询公司的牌子，向白老师问一个问题的收一
毛钱，＂在线等＂的算 Premium Service 多收五分。系主任胆子太小，今天老师还说
，我们动手罢！他却总说道Ｎｏ！——这是洋话，你们不懂的。否则早已发了。
所以老师抄起剪子和浆糊，助白老师和其他大侠一鼻之力。

发帖数: 30 | 13 1. 好消息是，法律规定，如果她能够签H4回来，那么只要能够到美国，她从前的任何
Status都已经clear了。也就是说，不管她以前有没有unlawful的状态与否。她的状态
就是从H4这个合法状态算起。也就是说任何非法移民，只要离开美国，再通过合法签证
到美国，他以前的非法状态在申请绿卡时不必理会。实际情况是，根据的非法时间的长
短，这些非法状态会遭遇1-10年的bar。并且有可能终身被拒签，即使bar的时间已过。
2.好消息2 是，根据245k条款，EB base的绿卡，递交485前，最多可以容许180 days的
unlawful的stay or work。
3. 坏消息是，485 pending期间，很短的时间就回国签H4回来，估计不是用advance
parole进出海关，因为advance parole需要3个月才能下来，楼猪很明显根本没考虑此
问题。如果是这样，她离开美国 wothout advance parole，此情况视为485 abandoned

去年开始在ebay上面卖点自己二手的鞋子衣服 后来发现有很多人在resell sneaker自
己就也开始倒卖鞋
不知不觉就超过了$20000 AND 200 transactions 的 limit （虽然我开的是个人帐号
没有开ebay store。。。）,今年年初收到了paypal寄给我的1099k表。。。
收到表查怎么报税才意识到严重性 属于unlawful employment，请大家给出出主意有什
么挽救的办法
1. 我现在属于out of status ? 会影响我出入境吗？
2. 想近期回国一趟 这个情况我应该避免回去吗？
3. 我在网上查到“could have exited the country and re-entered and cleared
the record because generally unlawful employment is looked at from last
entry.”
如果我今年回国一趟， 那么我去年的这个问题就不会被查了？

come back. They just need your wife to show the proof that she indeed used
H4 Visa.
For your REF, it's not clear since you didn't mention your I-485 receipt
date. In general, they only care the unlawful

这个是硬指标，没法绕过。撒谎也没有用，签证官那边可以查到记录。
不超过180天的unlawful presence，不会必然导致签证被拒。
但是会在多大程度上增加被拒风险，这个就不好说了。
out of status只要是authorized stay则没有问题，不会计入天数。 |

是AP身份， unlawful stay 是从485被拒到其他身份生效之前。 485被拒之前用AP的时
段是算

发帖数: 550 | 32 自告奋勇替版主答一下，不对不要怪我，个人认为这个是显然的。
用AP入关，成为Parolee，不是身份而是Authorized Stay，唯一一条获得非移居民身份
是之后用H-1B EXTENSION回到H-1B身份，没有其他非移民身份可以回（不离境情况下）
。由于你没有非移民身份，你无法Change-of-Status，即使你要COS也必须在提交当日
有合法非移民身份。
至于485被拒是不是要马上离境，其实差别不大，假定不超过180天-你会进入OOS,但只
要没有超过I-94上的日期你并没有自动获得Unlawful Presence,存在理论可能性被放进
递解出境程序进而被移民法官认定你的Unlawful Presence，但是不超过180天并不会触
发任何admissibility bar，只是会降低你获得非双倾向非移民签证的可能性，鉴于你
已经交了485拥有了完美的移民倾向，这只是把0.1%的概率降到0.01%而已，没有本质区

10。我可以拿得出的证明材料是：
a) I-20 允许我在2009.1之前毕业
b) OPT时申请的EAD 2009.1 - 2010.1
请问这两样足够证明我合法没有gap了吗？我实在想不出来当时opt时学校有没有给另外
一份证明文件了。还有什么文件可以用作evidence呢？
还有，我太太当时并没有工卡，她一直是F2，请问她应该用什么文件证明呢？

1：尽管APPLE 讲他们向李女士发了违禁令，但李女士从没有从他们手中得到任何书面
材料；若是口头违禁令，在人员嘈杂的店里，不懂英文的李女士，又怎么听得懂呢？
APPLE店和警察自始至终没有找人翻译，还在李女士试图用手机上的翻译软件与他们交
流时试图拿走她的手机，还对记者讲她能听懂，态度何其恶劣！
2：李女士周二去APPLE店，只是去取已在网上交过钱订好的手机，这两个手机已是她的
个人财产，她有权利去店里取她的个人财产。（APPLE要了人家的钱，却不给人家东西
，到哪里都说不过去）。
3：APPLE店讲李女士周二在店中录像，但李女士是在排队时被推出店门并逮捕的，她那
天根本就没有机会录像。APPLE店为什么要撒谎？（店里的录像记录应该可以证明这一
点）
4： APPLE保安让李女士离开店里，李女士就在他的推搡下走出来店门。他还是要逮捕
她。逮捕的理由是什么？

今天和老婆在St.louis(Chesterfield)看房子回来路上，被警察pull over,然后说我们
在限速６０的路上开70-75.然后警察问我要driver license和保险，老婆一时紧张找了
２分钟在车内没有找到保险。 条子这时回车开罚单，老婆在这段时间内找到了保险文
件，但条子回来给他看时，条子说我们没有及时给他看保险证明，他罚单已经开好，叫
我们上
法庭或者给法庭打电话说。我当时没有太在意，回来后仔细一看有２张ticket.

month价格和one year一样，我选了month by month （因为是affordable housing，
rent有cap）。现在房东想反悔，说不offer month by month to affordable housing

大部分在美华人作为职业技术移民，却饱受等待绿卡的煎熬，最近华人在绿卡身份排期
上连吃暗亏。所谓爱哭的孩子有奶吃，自如果属于自己的正当权益都不去主动争取, 那

州府奧伯尼(Albany)Bethlehem鎮一家中餐館員工涉嫌盜取30多名顧客的銀行卡信息，
並盜刷近5萬元。當地警方5日逮捕店裡四名華裔員工。
這家中餐自助餐廳Golden Town Buffet Hibachi & Sushi在6月才開張，中文名字叫「
迨⒃础埂＞奖硎荆y行卡信息洩漏情況從兩個月前餐館開門的時候就開始了，受害
者大都是該鎮和附近的居民。警方認為餐館管理者對此並不知情，管理者正在配合警方
調查。
Bethlehem鎮警佐Adam Hornick表示，被補的李恆27歲，報住紐約市布碌崙，警察5日上
午搜查餐館時，發現李恆有一個信用卡讀卡裝置和一張偽造的密西根駕照。李恆目前被
