前几天网上输入receipt number 一直说找不到status，今天查了一下居然显示批了。
没想到才一周就批了，一直担心RFE，这下轻松了。终于可以不用担忧身份，可以做自
己想做地事。
Background:
半年university biology postdoc, 还留在graduate lab做postdoc。 老板给了
research associate title，支持申请eb1b.
authorship：8 journal paper（3 篇一作，IF:一篇8.5，一篇5.5，一篇0.5）+ 6
conference paper.
101 independent citation，来源于21 个国家。

还有，我的conference paper 也

下：

生物方向，国内博士，3年大学薄厚，2年大学Research Associate经历。文章总数20，
但英文文章只有5个，其中一作英文文章只有3篇（2篇在本方向重要核心期刊，但影响
因子只有5分）。所有文章的总引用次数为56，但所有一作文章的总引用次数只有2次，
其他54次均归于非一作文章。
推荐信6封：目前美国老板1封，前美国薄厚老板1封，荷兰1封，杂志邀请审稿的美国编
辑（目前老板朋友）1封，法国（目前老板朋友）1封，日本（目前老板朋友，现有课题

发帖数: 86 | 8 Yes, I got my EAD/AP 10 days after premium processing I-140/I-485
concurrently.
One may use the EAD card to work even without I-140 approval, but it is
risky. In the worst case that I-140 eligibility is denied, one has to leave
USA within certain days. In practice, people can either appeal or use MTR (
motion to reopen) to postpone the EAD revoking date. This is my personal
understanding, you may consult with the attorneys. |

My lawyer doesn't want to do PP for my application. She thinks that there is
a good chance that my I-140 will be approved and PP might lead to RFE. And
if I would file the application without PP and unfortunately get a RFE,
there is a 3-month window so that she can help me apply for Eb2 as a backup.
I still need to decide on whether I will do PP or not. |

a duplicate notice, which costs $200.

发帖数: 19 | 12 急问板上各位大侠，我现在在一家软件公司工作，最近找到了新工作，新东家已经帮我
做了H1B transfer，并且新H1B已经拿到了USCIS email的approve notice.
但是新东家比较规范，一定要等到收到USCIS邮寄的formal notice 才会跟我商定新工
作的start date。新东家的HR建议我在得到确定的start date后在提出离职。所以目前
我还没有跟现在的雇主提出离职。
但是，前两天现在的雇主突然跟我说公司资金紧张，没办法pay我薪水了，让我take
vacation，但是without pay。现在公司的HR跟我说他们不会把我从公司的payroll上面
cut掉，只是让我take vacation，不发工资，这样我还可以合法的停留在美国。
我感觉现在的公司的HR也不是特别清楚具体的法律规定，我怕糊里糊涂的out of
status
请问版上各位大侠，我这样的状态是否会对我的身份造成影响，会不会以后甚至影响到
我485？

要紧. 更何况你还有LEAVE WITHOUT PAY这个理由, 应该没什么问题. ANYWAY, 祝福你. |

紧FILE NIW,本想利用累计未修的年假（440小时，可以最多修240小时）争取一点时间
把NIW递交（知道有很大的风险因为马上找到下家会很难，但还是想试试），但老板却
以申请H1B有工资要求怕休假期间不发我薪水有人查（谁听说过这事）非要月底终止我
的合同
我有退路转H4但受家庭压力很大（不展开讲了），而且还是有一丝希望找到下家，最重
要的是想FILE NIW,目前准备进度达到80%，只等再赚1-2封推荐信.

join another company B, and B will file GC for me. can I port the priority
date from my old I140 to mine new one?

大约近两年前递交了140 NIW 过了， 今年初的时候实验室没钱了，从H1b转成H4，开始
了找工作，面试很多，可是一听到要申请H1b就都黄了。从不放弃，准备了EB1A 通过律
师在两个星期前submit了。到上个星期也终于找到新的工作，开始申请新的H1b。那时
候还和老婆开玩笑说会不会Eb1A的140先过我可以申请EAD。
结果这星期老婆的实验室老板说没钱，要被layoff了。问题是她老板一点不懂我们现在
的签证情况，根本没有提前两三个月，搞的没有时间去做应急安排。小孩还刚上学，这
下要回国了。说实话真想骂人，可我又不知道骂谁。不想怪她老板，因为他根本不懂这
些签证和辛酸。
想和板上的前辈请教，现在我们想申请leave without pay. 她老板愿意，明天我们去
international office谈。想先用Vacation 然后这样拖到我的H1b下来，我老婆可以自
然变成H4。请问这样可行吗？会不会对485有影响？
或者让我太太转F1，我F2过渡，请问申请一个F1大概要多久？像我这样140 niw过得，

the AP is approved". But I have neither received a Fingerprint Notice, nor
have my FP done in a local office. Hope I am going to receive my EAD card
soon although feeling strange about the approval of EAD without FP. |

要自己下功夫研究自己的case,再加好律师，先走O1,再上1B，挖掘，挖掘，再挖掘
citation， patent 的亮点，并让这些cite你的人（没有太牛的人）写推荐信，内容自
己把关。
