：那个法官认为三星侵犯了苹果专利，但是苹果需要证明其专利有效（“VALID”）。
而且当时我就指出来那个法庭的法官是韩裔。
今天最新的进展出来了：

Samsung Gets Some Apple Smartphone Patent Claims Dismissed

The iPhone maker’s claims that Samsung misrepresented its intent to license
certain patents on fair terms was dismissed and Samsung’s request to throw
out some of Apple’s antitrust claims was granted in a ruling today by U.S.
District Judge Lucy Koh in San Jose, California. Koh said Apple can amend
its complaint to revive the claims.
这个还只是暂时结果，而非最后判决。法官还没有对苹果对三星平板禁售的要求进行判
决。但是从第一天法官的表态到今天的后续发展明确驳回部分苹果专利诉求，看来这个
案子苹果确实要输在自己家门口了。虽然他们在欧洲澳洲连续赢了至少三个国家的相同
案子。 |

What was dismissed was Apple's claim that Samsung was in violation of anti-
trust stature when it try to limit Apple's ability to license certain
patents under FRAND principle. Apple's claim that Samsung violated Apple's
patent was not touched.
In addition, Apple could reword the anti-trust claim and resubmit. So only
minor impact to the overall case.
