发帖数: 86 | 1 前段时间我的车被撞了，肇事车同时还撞了另外一辆车。由于肇事车的保险limit只有$
10,000，而两辆被撞车的property damage加起来有$14,635，其中我的property
damage是$4,671，根据肇事车保险公司的pro rata distribution计算，我能拿到$10,
000的31.9％共$3,191，还有接近$1,500的差额，由于我没有买uninsured property
damage保险，这个差额从我的保险公司也拿不到。我的想法是等从肇事车保险公司拿到
$3,191的赔偿后，再去小额法庭告肇事车司机索取1,500的差额。
刚收到肇事车保险公司的property damage release，其中有一段话是这样：
Insured Driver: BBB
For the sole consideration of $3191.82, the receipt and sufficiency of which
are acknowledged, the undersigned XXX ("Claimant"), being of lawful age,
releases and discharges the above-listed insured(s), Anchor General
Insurance Company ("Company"), their successors, assigns, heirs, executors
and administrators, all other persons, firms and corporations and all other
persons qualifying as insured (collectively, the "Released Parties") from
any all claims, rights, demands and causes of action that the Claimant may
have against any of the Released Parties for prperty damage as a result of
the event on 9/23/2012 (the "Occurrence"). This settlement is the compromise
of a disputed form, and payment to Claiment is not an admission of
liability on the part of any Released Party.
这段话表明肇事车司机“the above-listed insured(s)”也是属于“Released
Parties”吗？如果我签了这份property damage release，是不是就等于我放弃了再向
肇事车司机（不是肇事车保险公司）索赔的权利？我应该在拿到肇事车保险公司拿到$3
,191的赔偿前就上小额法庭向肇事车司机索赔吗？ |
