The lawsuit alleges that J.C. Penney violated Massachusetts law by
requesting and recording ZIP codes from customers in its Massachusetts
stores who paid for purchases with a credit card. J.C. Penney denies any
wrongdoing and any liability whatsoever, and no court or other entity has
made any judgment or other determination of any liability.
What are the Options of the Class Members?
a.) Remain a Class Member. If you do not request exclusion from the Class,
you will remain a Class Member. Class Counsel will represent your interests
in connection with this settlement.
b.) Excluded from the Settlement. You have the right to be excluded from
this settlement. If you excluded yourself from this settlement, you will not
be bound by or subject to any judgment or settlement of the litigation.
You cannot be excluded if you use the Certificate.
If you wish to be excluded, you must submit a written request to do so. If
you want to be excluded, you must send a letter or postcard stating:
(1) The short name of the Action, "Brenner v. J.C. Penney Company, Inc.,
Civil No. 1:13-cv-11212.";
(2) Your full name, address, signature, and ask to be excluded from the
Class, postmarked no later than September 6, 2013.
Your written request must be sent to the Settlement Administrator at the
following address:

You must also send a copy of your request to be excluded to Class Counsel
and J.C. Penney's counsel at the addresses listed below.
