first home buyer, 今天,offer在一个还算可以得学区被接受了。由于竞争激烈,不
仅加了钱,还移掉了inspection & mortgage contingencies。现在已经没有回头余地
了,几天后就要签P&S,估计这是唯一的leverage了(大不了损失earnest money),之后
不知还能怎么着了。
时间紧迫,所以只好紧急请教过来人和代理们,我这种情况在签P&S之前,还应该跟房
东弄清楚什么呢?当然很多问题make offer前我问过了,比如water damage, insect,
roof age等等,自己看了两遍(当然都是看表面,没有细看),感觉房子本身质量还不
错。我也不清楚我该期待大家回答什么,但是帮我想想吧。很多在热区买房的人都会有
这样的情况吧。

大胆往前走,坚定地相信一切都能修。问问卖家能留什么,都写在P&S里,注意P&S上明
确写明,如果贷款下不来,仅仅损失earnest money.

没有房检Contigency, 要注意:
1. 地下室有没有裂缝;
2. 顶楼或地下室是否有发霉;
3. 地板是否平。不平是结构有问题。最简单办法是地上放一网球,看球滚不滚。各个
楼层都要看;
4. 看屋顶和墙接口处是否有明显裂缝。各个房间都要看,包括卫生间。
如果有,也是结构有问题;
5. 如果买的老房子, 看地下室是否有大梁, 如果有, 要看有没有虫眼, 有没有腐
烂迹象。 特别是梁和墙的接触点。
没有Mortgage Contigency.除非你有现金可以拿下, 要注意:
1. 最近银行有没有除工资以外的进帐;
2. 两年报税,有没有报loss;
3. Whether you own business;
4. Whether there was big jump in your income in the previous two years
unless you are new graduate;
5. Whether you have enough cash for down-pay in case appraisal value is
below selling price;
6. Depends on the price, if your loan amount is >$417k. you need to make
sure that you will have about 10% of the loan amount as cash reserve after
closing as well.
For first time buyers, I would strongly suggest you to work with an
experienced
agent for the purchase. A good agent can help you evaluate all the risks,
and may get better deals. Agent's use is not just about opening the door
and writing the offer.

Thanks. I have been on market for more than 6 months and actually went
through the inspections of two other houses (yeh, then walked away for
various reasons. Painful memory). So I am not that worried about the
apparent problems.

Oh, surprised at your last comment: you mean that if I fail to get mortgage,
I might be able to lose only the earnest money rather than the 5% initial
down payment at P&S. Is this usual or at the mercy of the seller?

5% is the earnest money. downpay is for mortgage.
I mean you might not only lose your 5%. you may be forced to buy that house
if you dont put that clause clear enough in your P&S.
one.more thing, check to make sure all public record matches what you
thought. verify all structural change or systematic update have all permits
in place. if not, have your attorney put contingency in P&S.

I see. What I previously referred were (1) the 1K earnest money which I
already submitted with the offer and (2) 5% of the final price as the
initial deposit that I am going to make when sign P&S.
Oh, I see the danger. Because I don't have mortgage contingency, so, even if
I fail to get mortgage, I still have to buy the house with money from
nowhere...
What I can do to minimize the damage of this worst case should it happen?

dont sign the P&S without that clause stating clearly you will only forfeit
5% and no recourse to other legal responsibilty.

frankly speaking, waived mortgage contingency means you have to buy the
house no matter what happen.
But some seller are nice and like to only hold that 5%. especially at seller
market, they dont worry to have next buyer.

like the tone you talk about this. Yes, I would appreciate the seller to
agree on this but won't be panic if they don't as I have thought about this
and believe the possibility is really low.

I have to clarify that my agent is doing her job and has reminded me
something but, as a first time home buyer, I am nervous and think that I
want to hear more, so I came here to collect "group wisdom".
