We are pleased to announce that after 6 years of our hard work, your hard
work, we finally have a bill that has a very good chance of actually passing
in the Congress in next 6-8 weeks.
For over 6 months, members of Immigration Voice have been working behind the
scenes to bridge the gap between various sides, coordinating between
different groups, our employers and petitioning the Members of Congress. On
the 4th anniversary of Immigration Voice rally, members from across the
country organized over 160 meetings with the key decision makers in the
Congress. To prevent any unnecessary attention we coordinated and organized
these meetings with an energetic and highly motivated group of Immigration
Voice members and leaders.
On 22nd September, Congressman Chaffetz and Smith sponsored H.R. 3012 in the
US House of Representatives. We applaud Congressman Chaffetz and Judiciary
committee Chairman Lamar Smith for leading the effort for removing per
country limits. Here is the press release from Congressman Chaffetz website.
H.R. 3012 is scheduled to be marked-up in the House Judiciary Committee
this Thursday and Friday. See details here on Judiciary committee website.
Here is the bill summary. This is a pretty big deal given the fact that not
one bill for high skills immigration has passed Congress since AC21 Act in
Oct 2000. This will be the first one in 11 years.
H.R. 3012 will remove per-country limits in employment based green card
category. If enacted, this bill will drastically reduce the wait times of
everyone in the current backlogs. A similar bill was sponsored by
Congresswoman Lofgren in August, 2008. So removing per-country limits idea
has bi-partisan support in the Congress. Immigration Voice applauds
Congresswoman Lofgren's leadership on fixing high skilled immigration system.
The progress made on the idea of eliminating per country limits is not a
matter of chance. It’s a result of your confidence in your ability to
change the unfair system, and the investment that you have made over the
years by contributing to Immigration Voice. Your time, effort and
contributions have enabled us to persistently organize events to petition
the Congress for eliminating per-country limits in employment based green
cards.
If this bill fails, there will not be another bill in 2012 because that’s
an election year where legislations do not happen easily. In 2013, the
chances are slim again and depend on election outcomes. So this is it.
Again, we wouldn’t have been able to get this bill moving if it were not
for your persistence and the investment you have made in Immigration Voice.
Now that we are here, let’s take it to the finish line and be part of the
history in the making. For one more time, we request you to please
contribute to the community effort to help us finish the work we all started
together and get H.R.3012 pass in the Congress.

Summary of H.R.3012 – Fairness for High-Skilled Immigrants Act
Section 2 (a) through 2(d)
• In Employment-Based Green Card category eliminates Per-Country
Limitation in making the system first-come-first-served (priority date based
) to make a fair high skilled immigration system. This will help reduce
backlogs and wait times for backlogged applicants (backlog dates back to
2002 in EB3 and 2007 in EB2). Full elimination of per-country limit will
happen in phased manner as specified in Section 2(e) of the bill (see below)
.
• In the Family-Based Green Card category increases Per-country
limitation from 7% to 15% to help reduce backlogs for family-based immigrant
applicants.
• Effective date for legislation will be October 1, 2011 (FY2012)
Section 2(e) [Transition Rules]
• During FY 2012, 15% of annual allotment of 140,000 green cards will
be reserved for countries
other than countries with top two countries that are most severely backlog.
Remaining 85% will
be purely first-come-first-served based on priority date.
• During FY 2013, 10% of annual allotment of 140,000 green cards will
be reserved for countries other than countries with top two countries that
are most severely backlog. Remaining 90% will be purely first-come-first-
served based on priority date.
• During FY 2014, 10% of annual allotment of 140,000 green cards will
be reserved for countries other than countries with top two countries that
are most severely backlog. Remaining 90% will be purely first-come-first-
served based on priority date.
• For FY2015 and beyond, total elimination of per-country limits. All
EB green cards allotted on purely first-come-first-serve (priority date)
basis.
• For green cards reserved above during FY2012,2013 and 2014, no ROW
country can get more than 25% of the reserved visas
• For green cards not reserved above during FY2012, 2013 and 2014, no
country can get more than 70% of total annual green card quota of 140,000. |
