The Impact of the Government Shutdown on Immigration Matters
Here is what we know so far:
AS U.S. Citizenship and Immigration Services (USCIS)
operations are primarily funded through user filing fees (rather than
federal government appropriations), we expect the agency to continue
operating as normal. All petitions and applications will continue to be
accepted during the shutdown.
Unfortunately, the Department of Labor (DOL)
has indicated that it will neither accept nor process any applications or
other materials (including audit responses) it receives during the shutdown,
including Labor Condition Applications (LCAs), Prevailing Wage
Determination applications, or PERM applications.
The DOL's suspension of activities is obviously of paramount concern to many
of our clients - particularly those dealing with difficult timing issues.
We will therefore keep you apprised of any developments as soon as they
become available.
Department of State:
Visa processing at consulates overseas will remain "100% operational" as
long as there are sufficient fees to support operations. There does not
appear to be any imminent threat of suspension of visa processing at any
consulate due to the shutdown. However, this could change with little
notice.
E-Verify:
The Department of Homeland Security (DHS) has advised that citizens and U.S.
businesses will not be able to access E-Verify, the Internet-based system
that allows employers to determine the eligibility of prospective employees
to work in the U.S., during the shutdown. Please note, however, that the
shutdown does not in any way affect the requirement that employers complete
a Form I-9 for each new employee within three business days of the employee'
s start date. If your company uses E-Verify but cannot access the system
due to the shutdown, please print and complete a hard copy of the I-9 (
available at www.uscis.gov/i-9) for any new hires or re-verifications. You
can then enter this I-9 information into E-Verify once the system becomes
available. (The E-Verify "three day rule," in which an E-Verify case is
considered late if created later than the third business day after the
employee first started for pay, has been suspended to accommodate entries
submitted into the system late due to the shutdown.)
We will continue to closely monitor the situation and will provide you with
updates when available. |

Benefit adjudications will continue, since the agency is primarily funded
through user fees. The Washington Post reports that roughly 98 percent of
employees are expected to remain on the job.
Individuals and U.S. businesses will not be able to access E-Verify, the
Internet-based system that allows employers to voluntarily determine the
eligibility of prospective employees to work in the United States.
Customs and Border Protection (CBP)
Inspection and law enforcement personnel are considered "excepted" and so
the ports of entry will stay open. However, staffing may be limited and it
is expected that there will be delays at certain ports of entry. Visa status
determinations made at the ports of entry (e.g. TN) should continue, though
it is expected that there will be delays.
Department of State (DOS)
Departmental entities will continue to operate until their respective
balances are insufficient to continue. While many appropriated funds expire
after one year, the Department has some accounts that are two- or no-year
funds.
Consular operations domestically and overseas will remain 100 percent
operational as long as there are sufficient fees to support operations.
However, if a passport agency is located in a government building affected
by a lapse in appropriations, the facility may become unsupported. The
continuance of consular operations in such instances will be treated on a
case-by-case basis by the Under Secretary for Management. As funds lapse,
visa and passport processing will be delayed, with exceptions made in
situations involving serious medical emergencies or other similar situations.
Department of Labor (DOL)
The Office of Foreign Labor Certification (OFLC) FLC functions are not "
excepted" from a shutdown and its employees would be placed in furlough
status should a lapse in appropriated funds occur. In the event of a
government shutdown, OFLC will neither accept nor process any applications
or related materials (such as audit responses). This includes Labor
Condition Applications, Applications for Prevailing Wage Determination,
Applications for Temporary Employment Certification, or Applications for
Permanent Employment Certification. OFLC's web site, including the iCERT
Visa Portal System, would become static and unable to process any requests
or allow authorized users to access their online accounts.
The Wage and Hour Division (WHD) will keep enough staff on board to be able
to "conduct an immediate investigation of any incidents involving serious
injury or death of a minor while employed or any transportation accident or
any housing safety violation involving serious injury or death of a farm
worker." |

我们公司今天发的信还说只有要取得新Visa的人会受到影响， 你这个貌似是不是也会
受到那个工资调查的影响？

发帖数: 635 | 11 如果是H1B extension，而且工作地点不变，可以用旧的LCA，就不受DoL关门影响。
如果H1B transfer/extension 需要从新办LCA，DoL不上班就办不了。

发帖数: 10817 | 13 我们学校的人说， 因为一些contractor会休假， 所以会从regular员工那里抽调人手
去处理以前contractor的工作， 比如收发邮件之类的地方。 所以progress应该会变慢
吧。 但是大概不会完全停下来。
