是符合EB2标准的。
第（1）个例子master+3yr当然符合EB2
第（4）个例子master+2yr OR bachelor+4yr不能算EB2。因为后一个要求不满足
bachelor+5yr的EB2要求。
文章根本没讨论EB2是否能降到EB3，而且这文章肯定很早了，并不是针对最近这种情况
写出来的。

标 题: PERM 一稿两投的奥妙

最近看了一些帖子，和 AILA 的 senior director 级别的律师进行了一些交流。终于
明白为什么说有些 PERM 可以同时 qualify 两种级别的 I-140 了（注意，是同时
qualify，但不是同时 file）。
这样的 PERM 申请，在其 job offer 部分要求的学位是硕士以上，经验上至少两年，
二者必须同时要求。
这样的 PERM 同时满足 EB2 (professionals with advanced degree) 和 EB3 (
skilled worker) 的条件。后者没有对学位的要求，只要是需要两年经验的工作就可以
申请。这也是 AILA 一直在公开文档中含糊其辞的地方，“Make sure the
beneficiary qualifies under the new category”的真正含义。
要求 Master's degree 的 professional 职位不一定满足 bachelor 条件，之前已经
讨论过多次，没有共识。律师界也在这一问题上没有共识。
这个 trick 只说明某些特定的 PERM 既可以按照 EB2 file I-140，也可以按照 EB3
file I-140。所以，至少通过 amend I-140 这条路应该是可以走通的。
AILA 律师没有回答一个 PERM 能否同时或先后支持两个并存的 I-140 的可靠依据。
AILA 列出的 Neufeld memo 理由不是很充分，因为说的只是 amendment 可以突破 180
天期限。看过那个文档的应该都明白了。
