H1B还剩两年多，请问140 approve以后换工作申请H1B transfer，可以一次性续三年么
？还是说不能续，只能到我目前H1B 的expiration date， 因为我的H1B 还没到剩下六
个月就过期的时候。谢谢啊。 |

，到时候不一定能extend了，如果到时候因为各种原因，新公司的perm不能在H1B第五
年之前file，就可能会有一个H1B的gap了。

续H1B啊。。。

petitioner都换了，还考虑什么过期的问题呢？
transfter的h1b能给多就要看6年还剩多久，接近6年就看是不是符合AC21里面140的状
态和排期的条件。

我6年H1B还差两年多一点，140 已批， 现在transfer， 新的H1B expiration date是
原来H1B的expiration date 么？ 还是2014/10（当前时间） + 3年 = 2017/10， 还是
目前H1B expiration date + 3年 ？
我觉得按你和版花女神的回复，我现在transfer， 新H1B expiration date 是原来的
H1B exp date。因为我H1B还没接近六年。只有H1B接近六年（准确说，是H1B 还差半年
以内），才可以根据AC21, 用 approved 140, 在transfer的时候，续三年。
但是看到上面其他回复，大家说在transfer的时候就可以直接申请3年，所以又不确定
了。。不知哪个对啊。。。私心当然希望我现在transfer可以一次性续三年了。

Yes, that is correct- you do not need to be in your 6th year of H1B to apply
for a three year extension based on an approved and valid I-140. This
extension can be for up to three years, but can be for shorter periods if
requested by the sponsoring employer, or USCIS determines there is not
sufficient qualifying H1B employment for the entire three year period. An I-
140 sponsor has the ability to withdraw the petition at any time, however if
an H1B extension based on the I-140 has already been approved, at this
point in time, USCIS will not revoke the H1B extension. Although an I-140
sponsor may withdraw the I-140 petition, there is no specific requirement to
do so.
