这个问询也取决于议员个人，帮我问的是个Congressman，交了表格材料，基本立马就
问了，然后告诉我移民局必须在30天内答复。
然后移民局泥马不早不晚，第三十天写了个很客气的信，告诉议员Name Check，他们也
没法进一步处理。
然后我也问了一个参议员，参议员20多天后打来电话，工作人员很客气，翻来覆去说了
20多分钟，大意就是你还没有out of processing time，我们没法帮你问。。。。。

很多绿卡申请人在递交I-485申请之后，迟迟没有获得绿卡批准，究其原因是FBI Name
Check一直没有结果。其间，申请人个人和律师多次向USCIS询问申请进展，得到的回答
总是千篇一律的该申请正在等待FBI Name Check。等待时间超过1到2年的情况比较常见
，有的申请等待时间甚至长达5年以上。
除了消极等待，申请人真的没有别的方法了吗？其实申请人是有权利要求USCIS尽快批
准其申请的。如果申请人等待FBI Name Check时间过久，申请人就可以依据Mandamus
Action向当地法庭提出诉讼，要求申请尽快得到审批。该类诉讼申请人不需要上庭，诉
讼过程主要是通过双方律师进 行。
之前我们曾经多次介绍过我们事务所帮助I-485申请人通过Writ of Mandamus (WOM)诉
讼，成功获得绿卡的案例。我们事务所今年年初的该类案件平均批准时间大约是4到8个
月。最近一段时间，我们事务所的该类诉讼案件有加快获得批 准的现象，有一些申请
人从提出诉讼到获得I-485批准仅用了不到3个月的时间。
总结我们最近4个月的案件，2007年4月份之后，我们有8位I-485申请人在提交诉讼之后
的3个月内获得I-485批准。平 均时间大约为7个半星期。
以我们最近获得批准的案件为例，申请人在等待FBI Name Check近2年的情况下决定提
出诉讼，我们提出诉讼之后，申请人在2个月之内就收到了I-485批准通知。< /div>
当然也不是所有的该类诉讼都会在2、3个月之内就获得批准。但是我们最近的案件确实
显示该类诉讼有加快获得批准的迹象。我们的案 件进一步证明了Writ of Mandamus (
WOM)诉讼仍然是加快FBI Name Check，最终获得绿卡的有效途径。

2008 我知道我是被name check给卡住了，期间给议员写信，收到回信说是FBI在做
NC.期间去过一次info,基本等于没有去，因为我没有得到任何信息。因此不建议去做
info,浪费时间。所以，到现在我也不知道什么时候过了name check。由于年初有一个
memo,我觉得NC不是很重要了。 2. 经验 140屁的很快，只用了1个月，然后就是漫长的
等待，事情往往是这样的，有时快，有时慢，当我刚刚为140高兴，就不得不接受漫长
的等待的现实。开始的时候，认为可以用EAD工作，以及AP回国，因此，对485批不疲不
是很着急。但是，瞪了三年了还没有动静，因此不得不有所作为。在7月的时候，知道8
月的排气到了，就准备了WOM,在8月的第一天交到当地的联邦法院，然后就是等待。 8
月底收到第三次打指纹通知（FP的有效期是15个月，我的刚超过几天），劳动节后的第
一天高高兴兴去打指纹，看到门口可恶的门卫，心里想希望这是最后一次看到他。 然
后，4，5号，连续两天LUD.今天收到批准邮件。 3. 我也不知道是否是WOM的作用。但
是花了350块美金，我宁愿认为是WOM最终让USCIS重新收起架子. 我建议如果你花得起
钱，又对漫长等待失去信心的话，就干脆搞他们。具体的步骤： 1） 认真阅读一下这
个帖子，先对WOM有个认识 http://boards.immigrationportal.com/showthread.php?t=194681&page=1&pp=15。 2）告的步骤， 可能每个州少有不同。但应当是类似的. 所有都是Pro Se,也就是自己告，没有请律师。你需要的文件样板,上面那个帖子有： "485-civilcoversheet.pdf"--- 就是法院用来对你的案子分类的表。 "I-485LawsuitforGreenCard.pdf"-- 就是你的陈述 说谁是原告，谁是被告，为啥告他们，你想怎莫解决。 可惜是.pdf 文件，不是需要你们自己打出来到word里。 被告有：Texas Service Center Director, USCIS Dirctor,Homeland department Director.由于年初的memo，我没有把FBI放在被告里。 同时把你给议员写的信，以及回信等都做为Exhibition, 附在coplaint的后面。 3）造访你所在地的联邦法院的Pro Se office，纽约地区是http://www1.nysd.uscourts.gov/index.php， 然后把complaint交给clerk,他会给我一个Coversheet, 我当时填完后，给他。然后交钱。得到收据后，他会给你一个case number,一个summon。 复印几份summon和complaint,然后把summon和complaint寄给每个被告一份，用USPS的register mail,这样你可以追踪信件。最重要的是寄一份给当地的联邦attorney, 纽约地区是http://www.usdoj.gov/usao/nys/。 找到办公室地址，我亲自送过去，让他们在summon的复印件上，盖个章子，这个很重要，因为拿这个复印件回到Pro Se Office，连同summon原件给clerk,说明attorney 已经收到你的summon，只有这个时候，60天的期限才开始计数，因此，一定要尽快让pro se office尽快拿到attorney收到summon的证据。然后你就开始计数了，中间给attorney办公室打了几个电话，主要是骚扰一下，让他们记得你，尽快来办。 现在就想到这么多，有何疑问，就发悄悄话。 |

If you read between the lines:
The 1st memo says ajudicating officer should approve the pending 485 when
the applicant's name check has pending for more than 180 days and otherwise
approvable.
The 2nd memo rescind the adjudicating officer of such power, rather the
officer should report to the CIS headquarter for HQ's approval.
