EB2->EB3 concurrent filing RD 3/7/2014
下月按EB2 current但是EB3不current，想看看怎么能给LD把485交上，所以通过议员问
了一下USCIS。今天给了回复，不知道是不是问问题没问明白，给的回复看完有些疑惑
，大家帮忙看看。
Both of Mr. FranklinDou's I-140 petitions contain the priority date of 11/09
/2011. According to regulations regarding adjustment of status, when an I-
485 Application for Adjustment of Status is filled, the priority date must
be current on the visa bulletin at the time of filing as well as the time of
adjudication of the application.
看完第一句话，我的理解我的EB2 I-140还是有效的？
接下来两段讲我的485递交是有效的，另外我下个月没法按照EB3给LD递交485因为不
current。很好理解，就不贴了。
Furthermore, the second preference category priority date in May 2015 is
projected to be 06/01/2012, which would make a visa current. But since Mr.
FranklinDou filed his I-485 based on third preference he cannot change to a
second preference now. The reason is because when the I-485 was filed by Mr.
FranklinDou in 03/2014, the priority date for second preference was 02/15/
2009, which means it was not current. If Mr. FranklinDou was to file an I-
485 for his wife and change the preference to a second preference he would
make himself ineligible and in turn, make his wife ineligible as a
derivative.
这段说因为我交485时候EB2不current，所以我没法从EB3变回EB2了？这什么道理？ | s********c

发帖数: 1089 | 3 降级到EB3交485以后能否relink回EB2? 就是说EB3的485是否通过简单的relink就变成
eb2的485了？ 还是说要re-file EB-2 485? USCIS的意思好像是不行。我觉得未必对。

你没有二类的485她当然就没法在二类下交485。我估计只有你先转成功了，她才能交。 |
