Good afternoon xxx,
This E-mail message is in reply to your inquiry regarding the Forms I-485,
Application to Register Permanent Residence or Adjust Status, which your
constituents, Mr. xxx and Ms. xxx, filed with USCIS on xxx, 2014. According
to USCIS records pertaining to these cases, Mr. xxx is the principal
applicant; and Ms. xxx is the derivative applicant. Please note that it is
standard protocol at the Nebraska Service Center (NSC) to process the
permanent residency cases of immediate family members (principal and
derivative applicants) together. USCIS records indicate that your
constituents’ cases have not yet been assigned to an adjudicating officer;
however, the immigration files containing the permanent residency
applications of Mr. xxx and Ms. xxx are currently in transit to the
employment-based Form I-485 unit at the NSC for review.
USCIS records confirm that two underlying approved Forms I-140, Immigrant
Petition for Alien Worker, are associated with Mr. Xxx’s permanent
residency case. The first approved Form I-140 (LINxxx) places your
constituents in the employment-based Second Preference (EB-2) immigrant visa
category with a priority date of xxx xxx, 2012. The second approved Form I
-140 (LINxxx) places your constituents in the employment-based Third
Preference (EB-3) immigrant visa category with a priority date of xxx xxx,
2012. The aforementioned NSC unit may review the immigration files
containing the approved Forms I-140 and your constituents’ Forms I-485 to
confirm the current basis of these permanent residency cases as well as
their appropriate placement in a processing queue from which they may be
assigned to an adjudicating officer.
While we are unable to grant requests for expedited processing in employment
-based Form I-485 cases and determine the date on which the adjudication
process may be complete, you may follow-up with the NSC Congressional Unit
after approximately 30-45 days from the date of this E-mail message. We
would be pleased to provide an additional case status update based on a
future inquiry from your office and available information. If we can be of
further assistance, please let me know.
