Unfortunately, the I-140 EB-3 filing cannot be filed by premium processing
since we do not have the original labor certification (it was previously
submitted with the EB-2 filing). USCIS does not allow premium processing on
I-140 petitions where the original labor certification was filed with a
prior I-140, as it was in Xx's case. Current processing times on I-140
petitions filed by regular processing are taking anywhere from 4-9 months.
We are seeing more of an average of 6 months recently
