标 题: 紧急求助关于H1 offer term的事

大家好，想和大家紧急咨询一个关于offer term的事：
我老公是H1-B签证，在一所滕校做Research Associate，工资是系里面pay的，直接上
级是印度人老板，Department Chair算是sponsor。
今天下午（8月31日）突然被HR和直接上级约谈，给了一张上级署名的信，说合同不再
renew。我老公很奇怪，说offer letter（直接上级签名的）上不是说到16年3月底么，
而且H1-B status也是到那个时候；HR说“正式”的offer letter（院长签名）上是说
到今年6月30日，7月1日起是新的fiscal year不打算再renew。“正式”offer letter
（院长签名）确实是到6月30日，当时很奇怪，还专门跟直接上级咨询了下，他说那个
只是为了match fiscal year, 真正聘用期还是以原来offer letter为准，而且如果lay
off回给几个月通知的。老公太老实就没有追究下去，6月30日过了也没去讨要新的所
谓“正式的”院长签字的offer letter。。。
然而现在离6月30日，都已经上班两个月了，工资也都照发事情照做，都以为这个事情
过去了。就是上周起，老印上级鬼鬼祟祟地旁敲侧击projects结果能不能上周给，要嘛
今天（8月31日）上午给；虽然和他关系一直都不好（他实在太混混了。。。什么都不
懂又喜欢各种操纵挑拨），也没多想。。。今天下午突然发难，我老公整个蒙了，然后
要求交出门卡直接禁止进入整个大楼。我老公抗议说没这么开人的，时间这么紧，合同
期乱七八糟；HR说时间紧所以才补偿你一个月工资（多发9月份的工资），然后说也可
以给你们买机票回国啊（我老公咕隆了下H1 transfer的事情，HR貌似神色紧张）。迅
速聊完之后HR迅速给international office，ISO写信说在美合法身份立刻终止云云。
。。
现在还是一头雾水。。。想询问学校这么做合法么（搞个到6月底的合同，相当于没合
同工作俩月，又突然不继续了），然后我们有什么对策么

你们不找律师很吃亏
而且把一切能保留的证据都备份（email之类的）

找律师是一定要的。

但是最后的辞退信中有句话不是真的：说as discussed, june 30 is the last day...
boss想造成之前就跟我商量过的假象，其实之前我完全不知情

不是特别懂，打官司估计没那么容易，感觉不如好言求助现在的boss renew contract
（多延两个月即可），就算言不由衷的也好，好汉不吃眼前亏，然后赶紧找下家，或者
看能不能跟前大老板走。
或者本版有哪个大牛faculty钱多的愿意施以援手以解燃眉的。。。

of the employment, it could be in direct violation of their own faculty
handbook. Many universities have certain guidelines in the faculty handbook
regarding the non-renewal of faculty.
Two potential issues:
1. Your school may not have something like that at all, or it may only apply
to tenure-track faculty.
2. Legally, depending on which state you are in, the faculty handbook may or
may not be treated as a contractual agreement (there are cases that support
both sides).
It does not hurt to check though. If the handbook does have anything in
there about how much advance notice they have to give you, then use that as
leverage when negotiating with them. If there is an AAUP chapter at your
school, contact them to see if they can offer any assistance.

别怕事，官司打起来应该有办法可以延长合法身份

2. Do not communicate anything with either the "Indian boss" or the "Chair",
only with HR.
2. Don't call HR, ask questions through email if needed. Don't visit HR
unless is absolutely necessary.
Meanwhile, try to find another position or a school to transfer to F visa.
It's possible the former boss left due to failing the political fight and
they only kept you long enough to make sure the transition of "project" is
smooth. |

You may have legit grievances with your former employer, but of the utmost
urgency should be to find a job. |

这句话说得非常好。至少要对方作出经济上的赔偿，律师嘛，当然要赚钱了。

发帖数: 99 | 20 辞退信没有需要我签名的地方（他们可能也考虑到我不会签）；现在确实只有HR和我打
交道了，基本上是通过email，不过也就是处理些personal belongings之类的事。他们
连project都没打算让完成，合作者今天还在发email问进展。。。苦笑
十分感谢建议！打算先move on，有机会再回头处理这学校的破事。。。

身份呢？如果没有身份，学校在此期间也给他pay工资了，那是不是学校也违法了？而
且这期间没有身份的话，以后lz跟移民局打交道如申请新的h1b或者绿卡都会有麻烦的
吧？怎么解释这期间的空缺？
boss和lz得是什么关系才能弄的如此没有商量的余地？
想不明白啊！

were let go without any prior notice. Let him know you are looking for a
position and will try your best to put him in touch with the person that's
in charge of the project. However, you don't know who is really in charge of
the project.

supervisor和新的department chair一直藏着掖着这事，老chair上周离职（之前俺有
点不好的感觉，跟他询问有啥针对我的调查么他说没听说啊），这周立马让俺滚蛋了。
。。只是没想到他们连正在做的几个项目都不要了。。。

? If not, somebody has to be scared of that and instruct HR to tell you that

For yourself, no need to dwell on it too much, find an other position ASAP.
If you haven't pushed back at HR yet. You can even try the same institution,
different department. I don't think the HR cares about that one way or
another. They are there to protect the institution, not the department you
are in.

terminated.

Services (USCIS) by letter when there has been any “material change” to
the terms and conditions of an approved H-1B petition, such as when the
employment of an H-1B employee has been terminated. ”

这个网址的内容没法拷贝，感觉你现在挺像其中的第6个问题，就是提到severance
package的那个。
你确实应该赶紧找律师，咨询如何保住你的身份直到有下家给你submit新的h1b
petition，估计也花不了多少钱，一般找律师办个绿卡都才四五千美元。至于怎么跟学
校打官司可以等到你保住你的身份再说。
个人的理解：
鉴于上面第一个网址提供的信息，应该以学校通知uscis的那封信提到的termination
date为准，看样子，你的学校还没有通知uscis，一切都有回旋的余地，如果你能说服
系头的话。那个你说的contract学校可以写新的给你签，日期可以trace back，譬如，
系头良心发现，决定再给你两个月，系里可以制定一个新的contract，开始日期可以是
07/01/2015，然后截止日期可以是譬如12/31/2015,相关人士都签名即可，当然工资得
pay到12/31/2015。
按第二个网址的信息，就算学校已经通知uscis你的termination date （譬如06/30/
2015)，这3个月的工资（从7月到9月底）是按severance package pay的（保存好你的
pay stubs)，如果是这样的情况，technically 你这三个月已经out of status了,但是
你应该极有可能来的及transfer新的h1b，因为新雇主给你提交新h1b petition的时候
只需要你提供你的pay stubs（按你的说法，至少能到9月底），uscis极有可能不会管
这3个月空缺期，但是不guarantee不会追究。
总的来说，先别签任何文件（除非是新的contract renew的文件），咨询律师最重要（
先别急着打官司，先着手咨询怎么保住身份），口头问问HR已经通知uscis了没，如果
通知了，哪天是通知中说的termination date（contract那个06/30/15不是真正的
termination date，也没有那么重要，如果系里回心转意，一张新的contract就可以在
时间上续上来，除非学校给uscis的通知中提到的就是这个日期）。
again,上面是我个人理解，权威说法找律师，先保身份，跟系里打官司的事以后再说。
