There are two things DOL checks:
1. The job requirement.
2. Your qualification.
If the job requires only BS, even if you have PhD, you can only apply for
EB3 for 140.
BTW, Labor Department does not care if you are doing EB2 or EB3. They are
going to only check the job requirement (degree, prevailing wage) and your
qualifications (degree, salary level). |
