485 is linked with EB1 I-140. This case satisfies all three criteria of AC21
, but does AC21 apply?
3 criteria of AC21:
1) I-140 approved (2011/01)
2) 485 pending over 180 days (Pending since 2007/07)
3) similar job

EB1 RD is 2011/1 and you change job in 2011/2, that's change job in only 30
days after filing EB1B (don't argue that I-485 pending 180 days because that
I-485 was not filed based on this EB1B). Can you show the true intent of
working for the EB1B job if USCIS questions?

发帖数: 20 | 4 这个同意，有两个律师提到可能会被怀疑intent的问题，而导致140 revoked。可是
intention这个东西怎么证明？File的时候双方都是全心全意的愿意，半个月之后公司
把项目砍了(as business need it)，于是employee的意愿改变了，再半个月employee
另外找到工作了，不能说申请当初没有intent给原公司上班啊。
如果CIS不纠缠intent这个问题，那字面上看，AC21的三条都满足不是？

发帖数: 8496 | 5 "intent" interpretation is up to USCIS officer. That's the tricky part.
And when there is no other objective evidence, the officer's superior and
AAO appeal office will not change the decision. |
