贷款也办的差不多了，贷款银行的appraisal report刚刚拿到，比12年前的appraisal
少了320个sft。Appraisaer说可能是因为楼梯那里一二楼是通的，他只算一层，前面的
appraiser算了两层。
当时买房子的flyer上面说approximate sft是3500-3999，现在的appraisal report说
是3280sft。如果啥都不argue就买了，又觉得非常不爽。但是现在已经有contract，
terminate contract的contigency（inspection，fiance，appraisal value lower
than sell price）都不满足。
各位达人，帮忙出出意见，非常感谢！ |

总价除以原来面积再乘以少的面积，就是他应该还给你的钱。

claim他们也不知道具体的面积？

既然差那么多, 更多可能是估价公司的问题

contigency都不成立。这时候还可以和seller讲价吗？

我们town的算法都是basement面积x2 如果是colonial的话。如果是cape的话是 x 1.75

仔细看了一下contract，发现我们粗心的agent准备contract的时候犯了两个错误：
1.价格她写了326000， 但是英文表述是“three hundred thousand twenty six & no/
100”
2. 懒agent在需要买卖双方签名的那一页，还是用了我们第一次给offer的签字，上面
写的是我们3月6号出的offer，3月8号过期。然后seller签名接受offer的日子是3月17
日。
因为这两个错误，我们是不是比较有把握把ernst money要回来？

个退出。很多房子面积都不准，你下一个也不一定没有出入，而且楼梯算两次也是很正
常的，一般high ceiling也算两次 |

第一个mistake，attorney认为既然我按326000在做贷款，对方可以argue只是一个typo。
第二个mistake，因为我3月17号后在按部就班地inspection，appraisal，对方也可以
说deadline实际上是被extended了。

the difference and ask the seller to show you their source of the data. it
may come from their appraisal. if so, get a copy of the measurement. hire
another appraiser to remeasure the house and find out the difference and
then decide. if you don't want this house any more, get you a very good
lawyer and prepare to fight. don't expect that you can get it solved any
time soon if you go that way.

此外找个房地产方面的律师， 看看有多少把握能把earnest money拿回来， 不要指望

yourself a good lawyer for help. remember, most of them contract is
protecting the seller more than the buyer. as for the agent, you also need
him/her to be on your side. push him/her away is not a good thing to do.
