seller有权把deposit拿走。 问题是 这个agent 还没有帮我们把 loan完全办下来，大
概还要1-2天。 我想我不能签，至少必须等loan 完全approved.
我想问他们说的是对的吗？ 我让buyer agent 出示条款。 上面说的好像也没有他们说
的那样。 请问他们是诈我的吗？ 另外，我现在需要extend Escrow closing的时间

发帖数: 3792 | 3 likely you are wrong for the most part.
you can remove loan contingency when your loan agent is quite sure you will
get the loan, meaning that the conditions remaining on your conditioned loan
approval are soft conditions.
Loan is done only when your escrow accounted is funded by the bank. I never
heard people remove the contigency on the day of funding (i.e., closing)
you have to either remove loan contigency or cancel the deal before the loan
contigency deadline
if you don't remove it after the deadline, the seller can cancel the deal
and according to one agent in CA, you SHOULD still have your deposit back.
This part is different from what your agent said, but laws are different in
different states.

backup offer in hand. Most of time, seller is willing to wait for few more
days, but not always.
the part I am not sure, but one agent told me is that, the deposit is safe,
if the seller cancels the deal because you don't remove contigency on time.

I hope someone can answer this question. The answer seems to be NO, the
seller can cancel the deal but cannot take your deposit.

escrow稍後會晚點還給你；簽了之後，如果你的loan沒能下來，如果又沒買成，可能損
失你的deposit，有時會外加seller的可能損失。

on your loan.
The lender makes the decision.
So NO loan agent can 100% 保证loan能按时下来
However, a good loan agent with experience will be honest with you and tell
you his educated guess of the loan success, then you can make a good
decision to remove it or not.

如果还有3-4天close, 现在已经是final approval了, doc都应该出了. 如果还没有,
还是小心点. 如果您的loan agent不能保证loan能做下来, 就不要签, 以前曾碰到过类
似的client, remove了contingency, loan又被reject了, 非常被动.
下次记得找一个care 您review的agent.

发帖数: 7982 | 16 恰恰搞反了，有 loan contingency,如果你 loan下不来而不能买方，你是可以拿回
deposit的。seller唯一可威胁你的就是不卖给你，但是离close就几天，seller这样做
毫无意义。相反，你要是remove loan contingency,，那么你没任何保护了，要是loan
下不来，或其他原因不能买房你都拿不回deposit.seller 估计看快close，你还没搞定
loan,怕到时成交不了，要你remove来保护自己拿deposit吧。
